Yes to being arrested on I-751. How much detail do we need to give?

My wife was arrested at our apartment for fighting with our roommate. She's the one who called the police however they still initially arrested and charge her because they were unable to determine who was at fault. Anyhow, the charges were dismissed within 2 weeks and we have certified court records showing the dismissal.

We will be answering yes, that she has been arrested. The form then asks to explain your if you answer yes.

My question is: How much information do we need to divulge about this arrest? Can we just simply state the she was arrested and that all charges were dismissed and to please see our attached court documents? I don't want to get into great detail about it because it wasn't her fault anyhow. Any advice would be great.

If it wasn't her fault, why wouldn't you want to explain that? I would think the opposite of what you stated. :)

Does this question relating to any arrests only matter for the time period right after getting the green card but before filing to remove conditions? Or does the question relate to any arrests for someone's entire life?

I ask because if someone was arrested before and during the green card process (whether IR/CR/AOS), this would have been vetted before they issue the green card. So the only arrest/s that matter for ROC would be any that occurs only during the 2-year conditional period.

ROC Journey (CA Service Center)

2016-Sep-14: I-751 form, check, supporting docs sent USPS Priority Express

2016-Sep-15: ROC application received & signed for by Lakelieh

2016-Sep-15: NOA receipt date

2016-Sep-19: $590 check cashed by USCIS

2016-Sep-20: NOA/ 1-year extension letter received in mail

2018-Feb-26: ROC case transferred to local office

2018-Mar-06: ROC approved via USCIS website (WAC status check)

During my AOS my lawyer told me not to submit a seperate letter explaining the arrest record. And i didn't . I just submitted all the court certified documents. Thats it.

Even during my ROC i just sent my court documents.

Both were approved no RFE nothing. And in my case i WAS at fault .

It specifically asks for an explanation. So you're saying I should just submit the final court disposition and say nothing about what happened?

I asked my Lawyer the same question because i know on the form it says " if you answered yes to so and so question explain on a separate sheet ". He said there is no need for that. Anyways also the court documents have every information they need. Right from what a person is charged with to the final verdict.

Btw I submitted court certified documents and the police arrest record.
