Dear all,

I'm in the process of filling up the I-864. I'll be supporting my spouse and my child. I'm living overseas with my spouse at the moment (our interview with the US Embassy is next month) and I've just signed an employment contract with a school district in Seattle to start work in August 2016. The job offer, as stated in the letter shows I'll be on a 2 year contract from August 2016 till July 2018. And my salary at $50k+/year.

Can I use this job offer as the 'income part' for the AoS ? Or must I be physically working at my new job before being able to become the AoS for my spouse and child ?

I also have about $50k USD savings in my bank account that I can use for the AoS.

Thank you !

A.

You need a job paying you money, not an offer. Do you have a signed copy of the contract? Depending on where the interview is taking place (which embassy) it's possibly enough. The savings are factored at 3:1 (asset to income) so that gets you $16,666.

If your child is a US citizen then they would not need a visa or sponsorship. The child is included in your family count along with any other minor children no matter where they live.
