Good evening everyone,

I have arrived to the US in January on a CR1 Visa, I am in a real marriage and my wife and I love each other. Lately, she started to have mental problems and she is going to counseling and she's on anti-depression and anxiety medication. Some times her mood will change and she will be a different person, she wont talk or she will be crying and sitting alone. She have a history with mental problems and she was diagnosed with BPD when she was 9 and it's all documented. She lost her job because of that and I am the one who is working and taking care of the bills, her doctor was talking to her about applying for permanent disability because that's the 3rd job she quits because of her condition. We have joint leases together,joint bank accounts and the utility bills are in our names. I have a clean record.

Some times she will tell me she wants a divorce, then later she will tell me she can't live without me and she loves me. She is unstable at all and she is swinging my life left and right, up and down. Especially when she imagines things which are not really happening but she acts as if it's happening or happened.

I am almost in the US for 1 year and almost married for 2 years. My question is will I be able to file for removing conditions alone if she wanted a divorce? or if I want a divorce because of what I am passing thru. If yes, what are the chances of my request to be approved/denied?

I tried helping her and supporting her but she keeps imagining things about me and herself which are not true. One day she went out to the store and later she txted me saying that she wants to suicide and I wont see her again. I went to the police station and told them to try to save her from herself, when the cops reached her she said she wasn't really gonna do it.

I appreciate any advice or information.

Yes, filing with a divorce waiver is possible and which strong evidence of a legitimate marriage your chances of approval are excellent. I hope your wife gets the help and care she needs. Good luck! :)

Hey,

I filed for ROC on my own too, I just got approved without a RFE or interview so it is possible. I sent in everything I had collected over the years and it was enough. Good luck, let me know if you have any specific questions. :)

Hey man,

my marriage lasted for 4 years, but we were together for 10 years. I came to the US in 2006, I chose a path that really is not desirable to mention here, but at the end of the day it worked out for me, I will now copy paste from the letter I sent to USCIS with regards to what I sent them. I explained my relationship with them, how things were and what went wrong, I was very honest and frank, I also kept from an early stage as much as I could from our relationship, I guess I learnt that from my father, he had countless documents of his life, even receipts from restaurants years previously, I wasn't that #######, but I kept things that I figured were important:

From my cover letter:

The following are the description of the attachments in the submitted order:

· Form I-751 waiver based on marriage entered in good faith but terminated through divorce.

· A money order for $590 payable to US Department of Homeland Security

· A copy of my permanent resident card.

· A copy of my marriage certificate.

· A copy of my Divorce decree.

· Copies of Arrest Records

· Copies of our joint Tax returns 2012, 2013, 2014

· Copy of our Drivers Licenses

· Copy of joint insurance cards

· Copy of joint ATT phone bills since marriage

· Copy of joint Time Warner Cable Bills since marriage

· Copies of past 3 leases

· Copy of joint HSBC credit cards plus statements since marriage

· Copy of shared Chase bank account since marriage

· Superfluous mail sent to either of us at marriage address

· Various photos of our relationship

Copies of documents submitted are exact photocopies of unaltered documents and I agree to submit original documents to an Immigration officer or Consular officer at a later date, if required.

Thats what I sent in, I expected an interview, but I guess they had my previous file and believed it was enough. The photos I sent in were obviously hard copy taken before the digital age, they were amazing and showed true happiness, I regret that I will never see them again.
