Hello everyone.

I had my interview in Montreal yesterday and everything went perfectly until he started reviewing our I-864 and supporting documents.

My husband collects disability and workers compensation benefits which I had proof of it all. In the interview I was told that the workers compensation doesn't count which made no sense and that just the disability amount alone didn't meet the financial requirements. WHICH should have been noticed at NVC and given a checklist for.

We now have to get a joint sponsor which we have someone willing to do that for us.

My question is - does the joint sponsor now only fill out an I-864 form? My husbands name doesn't go anywhere on it ? Any help would be greatly appreciated. Thank you.

The Joint sponsor will need to fill out an additional I-864 (I864-A if they are part of your household) with all proper supporting documents, and your husband still needs to have his as well. Your spouse will still be the primary sponsor, even if his income does not meet guidelines, so just make sure you correct all the income listed since you have to remove the income that doesn't qualify.

This is the best to my knowledge, and I'm sure some more experienced members can either correct or confirm. Good luck!

Thank you so much for you reply. The Montreal consulate already has our I-864 from my husband. They sent me away to have one filled out by a joint-sponsor.

I just wanted to clarify that the joint spooner i-864 is ONLY filled out on behalf of the joint sponsor.

The Joint sponsor will need to fill out an additional I-864 (I864-A if they are part of your household) with all proper supporting documents, and your husband still needs to have his as well. Yes, the additional form will only have their own information on it. Just make sure you read on how to submit all the proper documents that pertain to the joint sponsor as a few things will determine what supporting documents you need so you don't get delayed again with a RFE.

Edited to add: The joint sponsor should fill out their own I-864, as it serves as financial contract between the them and the intending immigrant.

Thank you.

"Nolabound So sorry that you didn't get approved on the spot. We've walked in those shoes so we understand. The good news is you have someone willing to provide the joint sponsor. It was one of the piece we needed as well. Just have the person complete the I-864 with all the supporting docs (Proof of income , (In our case they needed income of over $25000) &Tax Returns usually the two most recent ones -2013 &2014) and get it to MTL as soon as possible. The form will have information for the JOINT SPONSOR and the BENEFICIARY. They should have instructed you when you received the 221G to send via Loomis There is usually a wait of about 10 days from when you send it and they receive it to the date they actually acknowledge receipt because their mail goes to an off site facility and not where you had your interview. Once they do your status should change from AP to READY.. However MTL can take up to 8 weeks to review the document you sent prior to changing your status to issued. Hoping for a quicker turn around for you.

Thank you for the reply. We are gas sully waiting for the sponsor to fill the form out and attach what's needed and send courier express to me in Canada. I hope it doesn't take 8 weeks to review. I would like to at least be there by Xmas.

Montreals been pretty picky about financial lately apparently. We're K1, but on Tuesday we got a 221g because even though our cosponsor made over HHS poverty guidelines for the household, they still wanted more, and asked for another cosponsor. The CO only mentioned my unemployment once, he was more focused on that even though our cosponsor made over guidelines that he still didn't feel my fiance would have enough support.

I'm starting to wonder if maybe they've let too many people skim on by and are getting cracked down, but I feel you. I'm in the waiting game too friend. I wish you the best of luck!

Filed: K-1 Visa Country: India
Timeline

When my file reached Montreal I emailed them several times before my interview to check if any document is missing.

Then they emailed me back asking me to bring additional Canadian police certificates for previous names and aliases I used (which by the way I already have, but only sent one to NVC)

This is just some info from Boiler at this thread if you'd like it for your own info: http://www.visajourney.com/forums/topic/567902-cant-find-a-joint-sponsorre-apply-next-year/?p=7832954

I thought it was strange that workmans comp didn't count because someone literally just asked about that a week ago and everyone says it counts.

There's another married couple who made over the minimum that got kicked back for a joint sponsor.

Although some sources of money related to unemployment cannot be counted toward your income for purposes of filling out the Form I-864 on behalf of an intending immigrant (such as food stamps, SSI, Medicaid, and TANF), unemployment benefits are in a different category. They are basically insurance payments which you are allowed to collect upon based on your employer having paid into a federal/state unemployment system earlier.
For that matter, if you are also receiving any retirement benefits, worker’s compensation payments, or other benefits that are similarly considered “taxable income” by the IRS, you can count these toward meeting the 125% of Poverty Guidelines levels required in order to serve as an immigrant’s financial sponsor. (This comes from 71 Federal Register 35731.)
How long you will remain eligible for the unemployment benefits is an issue you should look into, however. The immigration authorities may consider this in assessing your ability to maintain the necessary income levels over time.
