Hi,

I am preparing to send off my I-864 AOS application together with the I-765 application for the EAD.

I came over to the United States on a K3 visa. I handed in my husband's and his father's latest tax returns at the K3 interview (my husband's father is the co-sponsor). Do I need to attach copies of those to the I-864 application forms? Do I also need to attach letters from their employers? Also, is it necessary to attach their bank statements verified by a bank official, and do these have to be for the last 12 months? Is proof of their assets needed as well?

Read the I-864 instructions, everything you need to include is spelled out there and that is your best source of information for what to do. Just a word of advice - include EVERYTHING they want, even though it says you may only send one years of tax returns, personally I think it is in the best interested to send all three along with all of the other pieces of evidence it is suggested you might include.

It is necessary to attach the tax returns. And although it isn't necessary, but optional to send in the other documents (bank and employment letters) it just strengthens you case that much more- maybe not the assets part unless they need them to make it over the poverty line.

March 14/09 Biometrics appt.

April 22/09 Date of Approval!!

June 25/09 Greencard arrives in the mail!

My joint sponsor made well over the poverty line, as evidenced in our documents, but we were still asked to send in more. That has happened to a lot of other people too so that is why I say send in as much as possible. Although, RFE's are so common on the I-864 there seems to be no guarantee that what you send will be enough.

Thats a good idea, about the bank and employment letters. Can you tell me exactly what those letters have to say or include? Or where I can find that out? Thanks

Employment letter instructions are on the I864. If a bank letter is needed (I can't remember it even being asked for on I864) then you will find the instructions on there also.
