Hi everyone,

I am checking to see if I got it right about the 3 months needed stay prior to application. This is for my Mother-in-law. Both me and my husband are US citizens. His mom will be 75 y.o. in 2016. But we will be applying before her 75th bday. She comes and goes to the Philippines where she is right now. But most months she's here in the US. In the application packet, I read about the fact that applicants should be in the US for 3 months prior to application. I don't see why this is so but is this really important, even for her since she comes and goes.

Right now she is in the Phils. and will be there for 2 months, then she'll be here for 5 months, which is when we plan to apply for her naturalization. We're hoping to lodge the application as soon as she comes back, but waiting 3 months.... is that really the case for someone who has been coming and going already? She currently has green card and has been for 5 yrs.

Any inputs are appreciated.

The 3-month rule has to do with jurisdiction of the USCIS field office that will approve the application. Usually has a bearing if you move around alot and have changed primary addresses multiple times. Don't think it applies to someone who travels overseas regularly but has a primary/single domicile in the US. That said, she maybe asked to establish her residency in the USCIS field office. She can probably show a utility bill, bank statement, State ID etc to establish her primary address.

That is good news. Thanks for you input. I hope you are speaking from experience. Although I find it hard to supply the latter. She lives with my husband and I but doesn't drive. So, utility bills are under our names and she doesn't have a driver's license. She only has a passport which has own home address. I hope that would suffice for evidence/proof of domicile.

You are applying for her? You are the applicant / she is the beneficary

She is the applicant and her current status is a permanent resident. Because my husband is a citizen, she was sponsored to come.
