Hi,

Kim and I are just starting to gather documents and filling forms for a K1 visa. We know it's going to be a long and tough but we are prepared for it. We were so glad to find this site which is such a gold mine of information. I have 3 questions though for which I couldn't find answers so here they are:

1- Is this a problem if we send the application while I (I'm french by the way...) am visiting her. I managed to take 3 weeks off and I'll be visiting her. We read that I should not try to visit her while the application is being processed as there's a risk of being denied to enter the US so we'd like to send it as soon as I land so the 3 weeks I'll be spending with her will be three less weeks of being apart.

2- In the letter of intent that I'm filing, what address should I put because I didn't get if I should put the USCIS address or the embassy's address. Do I have to put the USCIS address on the letter that the petitioner will send and put the embassy's address on the letter that I'd be sending to the embassy eventhough I didn't read that I should send any letter of intent to the embassy.

3- Has anyone tried to enter the US while the K1 application was being processed? What are the real risk except being denied and what are the chances of actually being denied. Ok for this last quesiton I might not have search the forum enough :)

This journey is just starting and we both know it's going to be really tough but if that's what it takes to be happy then so be it... :)

I made the letter to the agency filing with first, then the second letter will be addressed to the interviewing agency, sorry im not familar with the traveling rules.

It is fine to be present in the US at the time of application, I was and there was no problems, just note it on the application.

I didn't visit because I didn't want to risk it. But for me personally, any other time I visited they always gave me a really hard time and thought I was getting married so I didn't want to risk visiting with a K-1 on the way, many people risk it but for me personally, I wouldn't. All they do is deny you a visit, no harm to the visa, and you just waste a bunch of money!

Read the guides, they will help you with filling out the forms and the process :)

1. As stated, no problem. You have a 1-94 so you can fill that in and maybe give the date he's leaving (just a suggestion I heard from another poster)

2. USCIS, and both petitioner AND beneficiary send one

3. We are going to try it. My FI is coming beginning of April. In talking to people etc, the people getting sent back most of the time had good reasons to be sent back. They either had no evidence of any ties to their home country or had overstayed before. Bring LOTS of stuff, like a lease, letter from your job, if the non-USC has children, show that, any papers if you;re in school etc. I know on the London website it specifically states you ARE allowed to visit, just bring the evidence.
