Hi, I hope someone can help me answering this question.

My girlfriend and I are getting married. She lives outside the US. We are thinking about getting married in her country. Can I request a K-1 Fiance Visa for her even though we are planning to get married outside the US? Or do I have to wait to get married and make a petition as a wife?

A K-1 visa is for getting married inside the US. If you wish to marry outside the US, your girlfriend will need a spousal visa.

08/09/2020 -- Filed N-400 online

08/09/2020 -- NOA1 date

08/11/2020 -- NOA1 received in the mail

12/30/2020 -- Received notice online that an interview was scheduled

02/11/2021 -- Interview

The K-1 requires you to be legally able to marry and sign a statement that you will marry within 90 days of arrival in the US (after the visa is granted). You can marry wherever and then apply for a CR-1 visa after you have the marriage certificate.

Mar 18 2013: I-129F mailed to CSC Nov 15 2013: I-485 with EAD/AP filed at Chicago Lockbox

Sept 19 2013: Interview - Approved!! Jan 25 2014: EAD/AP Card Received

Oct 6 2013: POE - Chicago O'Hare June 2 2014: Permanent Resident Card Received!

Oct 27 2013: Wedding!
