I am the USC and will be petitioning my parents. My income will meet the poverty level for the household size of 3 (which I am thinking will be for myself (petitioner), my mother and my father (immigrants). I just graduated and started the job 3 months ago (so I don't have an ITR form yet).

Have one child and I live with him and the daddy (my fiance). My fiance supports the child financially 100% and he meets the poverty level for the household size of 8.

On I-130 form Part 5 question 4 "If you have a dependent child, enter the number here", should I enter 1 for my son even if the support is not coming from me?

Also, would it be beneficial Affidavit of Support wise if I sign up my fiance as a co-sponsor?

Hi,

Your household count includes your minor son. It doesn't matter if his father is supporting him 100%. You have a legal obligation to care for your child and that is what matters. The child is your dependent. Even though you do not financially support him, you have a legal obligation of support.

You will need a Joint Sponsor.
