question about restraining order or order of protection

Any input on my question will be highly appreciated.

Can restraining order or order of

protection issued at family court affect

N400 application? No citation, no fine, was issued a paper that asked me to leave my home. Do I need to disclose this on my N400 application? Waiting to hear back from anybody that know about this.

I just went through the N400 document and I did not see any Question regarding what you are asking....

Most of the questions on that form seemed pretty self-explanatory...Was there a particular question on that form, that YOU had a question about?

Thanks for your reply.

I will suggest there is nothing to be disclose right? since it's not a crime or citation. It's pretty much a way for someone to ask somebody to leave them alone. Well that's all the question I got.

More suggestions on this topic will be appreciated.

That is correct, which is why I asked if there was a specific question you had. Because I agree with you, from what I read on that N400 document, nothing asked about a civil restraining documents. The specific questions I saw were things like "have you been arrested, detained, or convicted" etc etc "Were you detained/forceably removed from the country"

EDIT: just answer the exact questions they want, and offer nothing additional. ( but be truthful )

Okay. Never been detain, arrested or removed out of the country before. Though I was escorted out of my home by a police after order of protection paper was handed to me. Does that mean anything? Sorry for repeated question. Trying to get this over with. Appreciate your time.

your making too big of a deal out of this. Just answer the question, that is all you have to do. Do not read into it or turn the questions into something they are not...

Is being removed from the home ( THE SAME AS ) -- Being removed from the country? The answer is no.

The answer to the Question: detain, arrested or removed out of the country:.. You would answer NO

You were ever charged with anything? You didn't have to go to court? If you were served with a Criminal Protective Order, then charges were filed and you need to list this. If no charges were filed, then this is a civil issue and not a criminal one and my own interpretation is the same as the advice above that it doesn't need to be mentioned.

Having said that, USCIS may have records of this civil issue too because a police report would have been filed, so you should be ready for questions about this matter just in case.

Here is what happened.

I wasn't charged with anything but only asked to leave and never come back or try to reach my ex.

because I still care for the relationship and was hoping things might still work out, plus I really do not have a place to go, I went to court to respond to the order of protection, hoping the judge will dismiss the case but to no avail. Didn't go very well, the judge decided to keep the order in place since we both still have our differences.

The whole thing happened in family court.

Now we are going through divorce.

What's your input on traffic citation?

I got a speeding ticket that's paid for.

Do i list that under the question "have you ever been cited" and send in proof of payment or not necessarily.

I have read on here from folks that you don't have to list traffic citation /ticket and some said you have to disclose it. Thanks

Take with a grain of salt.

I dont think you have to list Civil citations ( which is what most regular traffic tickets are ). I have had multiple speeding tickets and i did not disclose them. I believe the exception to this would be if there was criminal component with it or you were arrested.

The form asks if you were cited... traffic tickets are citations.

You have to list them.

People will say that their interviewers did not ask for traffic tickets or specifically told them that tickets didn't matter. Those people are absolutely right.

But others will say that their interviewers insisted on having tickets listed and that some approvals were delayed because tickets were not listed.

It's very clear that the interviewer will have access to your driving record.

So since there is confusion and inconsistency in how interviewers treat this issue, I would follow the instructions to the letter and list all citations.

You should also take with you proof that all fines were paid.

Okay. With my situation, you think its okay to answer no to "have I been cited before right? Sorry for back to back question.

I don't see how you can possibly answer 'No' to that question when you have been cited. The interviewer may or may not care, but the answer is clearly not truthful.

Thinking of sending in proof that traffic citation ticket has been paid. Things like receipt, instead of waiting to take it to interview. Does that make sense?
