Need help with some questions on 485

Hi,

I need some help filling out some questions on the I-485. I'll need to explain my circumstances briefly first I guess. Well I've been in the US for 6 years, initially coming in on an I-94 Visa Waiver, got married to a USC before that ran out, but haven't filed anything since, so I am "out of status". I am also filing I-130 as well.

So what I need to know is:

1) Part 1 what do I put for "Current USCIS status"?

2) Part 2 Application Type. I understand I should be checking box h., but what should I put?

3) Part 3 Should I put the I-94 number for the box "Nonimmigrant Visa Number"?

I think "out of status" should work (I put out of status/tourist) on mine, because I was not sure which applied to me.

2) Part 2 Application Type. I understand I should be checking box h., but what should I put?

You check off A, not H. Your application is based on the pending I-130 which gives you an immediate visa number if approved.

3) Part 3 Should I put the I-94 number for the box "Nonimmigrant Visa Number"?

Don't know, but it's probably the number of your visa.

No...you don't have a non immigrant visa...so you need to put "none"

I hope you don't mind if I tag a question on here, it's similar to what you have.

In Part 2 where jane2005 says to check box A, the form says to check that box if the immigrant visa has already been approved, which gazarama doesn't have. So shouldn't he mark box H?

I have a similar situation. I'm in the country with a K3 visa and want to file AOS, but my I-130 hasn't been approved. In fact nothing has happened to it since it was received in July 2006, which is mystifying all on it's own. So can I apply for AOS, and if so do I check box A or H?
