I am not familiar with the recording and registration of an Anullment and other Anullment related documents in the Philippines so I have some questions I would like to ask someone whom is knowledgeable and can give me accurate answers to my questions so that I can get a better understanding and also so that I will know exactly what (if there is any) other Anullment related documents that must me submitted with the Anullment as proof of termination of a prior marriage. My fiance has received her COURT DECISION (Anullment), AMENDED COURT DECISION, AND CERTIFICATE OF FINLALITY. Both the Court Decision and Amended Court Decision has been registered with the civil registrar office in the same city where the Anullment was issued by the judge as well as the civil registrar office where the previous marriage took place. I am in the stage of preparing my petition for my fiance at this time.

I've been reading other threads regarding what and which anullment related documents are required by USCIS to be submitted by the K1 visa applicant and from reading these threads by different members (all K1 applicants) of this forum, some members stated that they submitted their Anullment (photocopy) and all the other documents (all photocopies) mentioned above and were approved for their K1 visa. Some stated that they only submitted their Anullment and Certificate of Finality and were approved for their K1 visa. One member stated she only submitted their Anullment alone but none of the other anullment related documents mentioned above were submitted then 3 months later she received her her certificate of finality which was dated past the date of submission of the petition and did not receive an RFE requesting for any of the other above documents and was approved for her K1 visa.

Here are my questions and it refers to an anullment "after" it has been registered at the civil registrar office.

1. Who Annotates the marriage cetificate of it being nullified and void, the NSO?

2. Is the NSO the appropriate Philippine gov't agency whom maintain records of all Annotated Marriage Certificates?

3. Is the Civil Registrar Office the one to issue a Certificate of Authenticity?

3. Does the Ceritificate of Finality also must to be registered with the civil registrar office for the purpose of submitting it with the anullment in the petition?

Here's my MAIN QUESTION below.

Once you attain the divorce/annulment you will need the decision of the divorce/annulment (works also for an annulment same process she was divorced), entry of judgment, then the decree of divorce (annulment). Then you’ll need to secure copy of the marriage contract (from her marriage) with the divorce (annulment) annotated on it. A total of four documents. You’ll need to wait 20 days from receipt of the Solicitor General of copy of the decision before you can secure the Entry of Judgment. After securing the Entry of Judgment, you will have to register the same to the Local Civil Registrar where the marriage took place or Filipino’s hometown. The said office will transmit the same to the NSO. You will show the Court what date the LCR transmitted the documents to the NSO. With the proof of receipt of the NSO, the Court will then issue the Decree of Divorce (Annulment). After 15 days from receipt of the NSO of your documents, you can now request a copy of the marriage contract with the annotated divorce (annulment) proceedings. You need to request at least 4 certified copies for future use.

These are the steps you need to follow to ensure completeness for your visa interview. After these steps have been finished then get your NSO/CEMAR for your interview.

The submission of the appropriate anullment related documents are sooo confusing to me. You stated that I will need a total of four documents which are:

My questions:

Refer to no. 1 and no. 2: Aren't the Anullment and the Decision of Anullment the same thing since the Anullment is also called a "Court Decision? (I'm confused)

Refer to no. 3: What do you meant by Entry of Judgement? Don't the Anullment already indicate the judgment by stating on it that the marriage has been nullified and void?

I know what a CENOMAR is (CERTIFICATE OF NO MARRIAGE) but you mentioned I need a CEMAR for my interview (btw I am the Petitioner, you probably meant that the K1 applicant needs to have a CEMAR for the interview) anyway, what is a CEMAR? Did you mean to say a CENOMAR is needed for the interview? I thought a K1 applicant must produce to the USCIS and/or at the time of the interview a CENOMAR "only" if the K1 applicant has "never before" ever been married in which it would be an Annotated Marriage Contract in my fiance's situation.

This were the documents I got from the court:

1. Certification

2. Entry of final Judgement

3. Decree of Annulment

4. Decision

In my own personal experience ( being annulled ), this was what I did:

1. After the court finalized my annulment they issued me those document coming from the court. My attorney registered it at the Civil Register where annulment took place ( I have to pay a fee for that). Then I personally registered it with the Civil Register where my marriage took place( again another fee). Civil register then forward the document to the NSO. In my personal experience, it took me about 1 year before NSO annotated my marriage contract. (I have to personally go to NSO Office Manila hounding them to do what they need to do since it was taking them long time )

Annotated Marriage contract - This is the marriage contract that is annotated by the NSO saying that marriage is null and void.

When we started the I-129, we submitted all this document, just a copy.

Interview, original of all this document were asked. CEMAR is the annotated marriage contract since your certificate of marriage is then annotated already.

Based on my experience this is what i did..forgive my english as im not really fluent speaking it...

After i got my finality and decision i asks the court to give me copies i think i made five 10 pesos per page...coz they need to sign each page making it valid copies... Then the court told me to go to registrar to where the decision has been made..they are the one who will give you the certificate of authenticity... They put stamp on the finality and court decision again... Aftr that they will tell you to go to the registrar where the marriage recorded... By the way theres also my marriage certificate with me going to that second registrar... They are the one who will type the annotation of null and void thats my case at the right side of certificate... Then after that they are the one who will give a letter for NSO..Its like a request to annotate that certain certificate... You need to bring all of that.. finality court decision marriage cert with type annotation and the letter... Just bring all the annulment documents..rather be prepare than not... I paid like less than 500 then waited 21days...thats it... We just send a copy of finality and court decison in our k1 application then approved in 37days...yay...i remember everything..

Aftr waiting 21 days i got my authenticated annoted marriage certificate from nso...then since i dont have anymore time.. the next morning i went to our nso in our ptovince to get my cenomar..its actually cemar for those who got married..but they calling it cenomar..waited less than 3hours then i got it....

You should go to main nso for processing your annotated marriage cert...

In my case, I ddn't experience this. Everything of that was taken cared by my attorney ( I just gave him tho the fee to have the document registered at the Civil registrar where the Annulment took place). When all were done my attorney sent me those court Documents with a raised Dry seal, signed by the judge and clerk of court - Certificate, Entry of Final Judgement, Decree of Annulment, and Decision.

My attorney instructed me to bring the document at the Civil registrar where I got married to have it registered. Then the Civil Registar will process. They will tell you to come back when they get the documents processed and as far as I remember, they gave me a sealed envelop which I assume it was the dcument that NSO needs to annotate my Marriage contract. Then I mailed it via certified mail, so I get the tracking number and know when the NSO recieved it. The civil registar will then tell you the estimate when it will possibly the annotated marriage contract will be in the NSO database. I followed it up close to the NSO where I live.

In my case ( not everybody have trouble with the NSO- hit and miss I think ) I followed it up with my local NSO office ( I live in Leyte ) but it was already taking time ( not the normal time ) and my Annotated Marriage contract was no avail yet in their Database - I was getting frustrated and luckily, the local NSO gave me the ocntact person's number and email in the NSO Manila to directly follow up my case. But then again, it like just going around the bush. So I decided to follow it up myself, only to find out that NSO Manila lost my document - go figure .. theycan not deny they recieved it coz I kept the tracking number. So while I was there, they asked me the copies that the Civil Registar should have sent or made ( luckily I asked the local civil registar to make me another - since before I left manila, the head of the NSO who takes care of the this kind of document emailed me saying there were errors in the document that was sent to them - blah bah ). While I was there, they were not expecting my presence, I asked to see the document, but they can not locate it, so I handed them the document I then have. it only took them a few days to do their job then. Frustrating but this did happen to me.

I do not think you should really go to the Main NSO ...the civil registar will hand you the document needed by NSO for processing of the annotated marriage contract ( if you live far away ) you can mail the document ( the civil registar will hand it to you and it is sealed - they will instruct you where to send, whom to send it, and instruct you to send it through register mail so you know that it is recieved and they will instruct you when to start following up with the local NSO close to where you live and see if the Marriage contract is already annotated. You can secure the annotated marriage contract if it is already in the database in the local NSO close to were you live.

I only paid 80k to my annullment thats why i need to work for it...

After the court of clerk signed the finality...the part of my attorney in my case were done...

mine was part of the package. MY annulment so far was fast too, it was just the NSOwho messed things up not doing their work right.

What do you mean by going to the main NSO, aren't all NSO branches offices capable of producing an Annotated Marriage certificate for the recipient?
