Hello,
We've had our K1 petition pending for the last 4 months. We all know they're behind at TSC - that's old news. My fiancee lives in Brazil, and I live in Texas. I'm wondering:
Let's say I go stay with her in Brazil for 2 months (this would mean I quit my job). In the meantime, we receive NOA2. Seeing as how we would have a place to live upon coming back to Texas (my brother owns a house), and he makes QUITE enough to be eligible for co-signing, would him co-signing be sufficient for approval?

Ideally, I'll stay for 2 months, we receive NOA2 around the time I leave, and I come back and start working again. However, if we receive it sooner than later, would have a co-signer and convincing them that we're able to support ourselves be sufficient?

Thanks!

So if your plan worked, how would you pay for her ticket here, other moving expenses and your wedding plus the cost of AOS?

I know being separated sucks but asking someone else to be on the hook for your future wife and blowing a hole in your finances (which already sound week) might not be the best idea.

NOA 2. Really?

Some embassies do not accept co-sponsors, check in the regional forum.

This is really a poor answer to the question. Actually, it's not an answer at all. Aside from the fact that those costs are already covered, this topic is not about how I'm going to pay for my wedding. This topic is about the legal process; what they can legally count as our resources and what our resources actually ARE are two different things.

Needless to say, I don't need to detract and describe how I'll pay for this and that. That's my business.

So, once again, if anyone else has into on the role of the co-signer, let me know. I would prefer personal accounts to vague, snide comments. Thanks!

My comment was meant to be rhetorical and there isn't really much snide or vague about it.

By getting a sponsor you are asking someone to be responsible for YOUR wife until she has 10 years of creditable work experience. Next, look at timelines like yours. Your case could be adjudicated within a month or two at the most based on trends. With jobs being what they are why would you leave one now and assume you can step right back in to another 2 months from now?

The K1 process makes people a little crazy. We waited much longer than almost anyone that filed when we did. I was tempted to say screw it and go to Brazil and get married. People don't always think straight when USCIS forces them into situations like this by not processing their case for whatever reason. All I'm saying to you is step back and think big picture before you do something rash.

I can see how you perceived this as something of a personal attack and beyond the scope of your original question, but this kind of "big-picture" advice is fairly common on VJ and not always a bad thing. Many people approach the process without all of the necessary information (for example, the fact that AOS will cost you over $1,000 right after you get married, hidden costs of obtaining the visa like the medical exam and other fees, etc.) and attempt to make decisions based solely on what they know.

Brazil does accept co-sponsors, and the documentation you need to provide is covered by the guide and numerous threads in this sub-forum. If your brother is not aware of exactly what being a co-sponsor entails, you should explain it to him so that your plan to use him does not fall through after you quit your job, since that would be disastrous to your visa process as well as your personal financial situation.

Also keep in mind that you should arrange to have someone receive your mail while you're gone. If the NOA2 arrives (and let's hope it does!) you will need to keep the hard copy. If you get an RFE (let's hope you don't!) the instructions for submitting the required information are ONLY contained in the hard copy, so you will definitely need someone who can receive it and scan/send it to you or tell you exactly what it says, and then respond to USCIS accordingly.
