Hi, I am permanent resident and i fill petition for my wife. Last month i fill out I864. Today i got the check list 8 out of 10 are the common mistakes on the I864. But 2 of them are the serious one. They are looking for 2013 income tax return from IRS. I didnt fill any tax for 2013 because i was not in United State. I was in another country on the rentry permit from 2012-2014. I left united state on 2012 and then came back on 2014. During that period i was working for some other company, not in united state and my income is less than <$4000/year. Then i came back on feb 2014 and start new job in united state from april 2014. My income for 2014 is more than enough to support my wife petition but the check list which i received today they are looking for following 2 things:-

1. A written statement indicating why you did not file 2013 Federal income tax returns.

2. 2013 Federal income tax returns, IRS printout, or Letter 1722 issued by the IRS.

I am willing to give the written statement mentioned in Part 1 but really confuse about the Part 2.

If anybody can advise?

Really appreciate it.

hello, im no expert at this.. but from what i can understand is that:

you either have to send a complete i-864 attaching a writing explanation why you didnt file taxes on 2013 and the copy of the IRS statement that supports the fact that you didnt have to file (for example unemployed or low income..)

or you have to file your 2013 taxes if you received any taxable income..and send those papers to nvc

hello, im no expert at this.. but from what i can understand is that:

thankyou PatchSC for your reponse. In 2013 i was not in America. I was on my reentry permit since 2012-2014. Anyway i submitted that explanation to NVC. Lets see what happen. Otherwise i will submitt not tax filling transcript from IRS to NVC.
