I am residing in the US, and i'm married to a US citizen. We have applied for a family based green card. I got my interview date, but it was to take place in London, England. I am originally from the UK. WE applied over here in the states and expected the interview to take place in America. Can anyone tell me if you have to go back to your own country for the interview and medical? Also my passport has now expired. I have contacted them twice by letter, the interveiw was supposed to be in December, last year. I have told them in a letter what the situation is. I need my green card in order to work over here, I am running out of money. Any suggestions about what I can do would be appreciated, thanks.

What forms did you file???? I-130? I-485?

Sounds to me that you have filed for a CR1 visa..

yes filed both these forms. Family based visa through marriage not sure of the exact name for the visa.

You need to make an infopass appointment at your local USCIS office and find out what has happened to your AOS forms.... if you filed both I-130 and I-485 then on what visa did you enter the USA? did you get reciepts/NOA1 for both the I-130 and the I-485? have you had Biometrics done?

Can you tell us when you came to the US, when you filed for AOS, what letters you have got from USCIS

All of my forms and information have been sent to the American Embassy in London, England. Even though I applied here in the US. I entered the USA on a visa waiver programe, so I could stay here for three months without a visa. During that time I married my husband whi is a US citizen, and we filed for a marriage based family visa. I received an interview and medical date from the London consulate back in Decembeer last year, so all of my forms have been processed and approved. I was expecting to get the interview and medical in the US as I am residing here. But they expected me to go to the UK for the interview and medical. Do you think they made a mistake? They sent the letter informing me of the interview date to my home address here in the states, so its not as if they thought I was living in the UK. They know I am here and have all of my information on file. I got all recipts for fees that I've paid. Thank-you.

I am sorry to say you have filed for the wrong thing.... if you had wanted to file for AOS from within the US as a spouse of a USC then you should have mailed all the forms to the Chicago Lockbox...

As you have a approved i-130 you could reapply for AOS to the Chicago lockbox now... BUT i would advise you to have a meeting with an immigration lawyer to help you understand the process you are trying to follow....

Yeah it sounds like you didn't apply for a greencard but for a visa that would allow you to come into the USA and apply for a greencard after you've been married, which obviously does you no good since you're already in the USA. If you had applied for a greencard your interview would have been in the USA but since you applied for a visa the government assumes you're in your native country (since you applied for a visa to get into the USA) so that is why the interview is in the UK. You need to apply for AOS (forms I-485 and I-130) but before you do anything I'd definitely go talk to a lawyer to be sure you do everything right this time and avoid losing any more money.

Thank you so much for your help it has been appreciated. Thanks for the web link too. I just have one more question for you. I can't afford an immigrations lawyer, would I have to pay them right away?

A consultation with an immigration lawyer should not cost you more than $100-200 dollars, depending on where you live and how much time is needed to review your situation with you. You can't afford to not have a consultation.

After the consultation, if you feel that you need to hire a lawyer to work on the case, then you can discuss fee and payment options.
