Timeline

Do i need to legimitate my child to petition her? She doesnt have middle name on her birth certificate? Do i have to use her fathers last name and my middle name to file i130? Bec Me & her father are not married

Middle names aren't required. The form only asks for it if you have one. If the child doesn't have a middle name, then you leave that space blank. So whatever the child's name is on her birth cert is what you put on the petition because this is the name that her passport will be issued in. It doesn't matter if her father isn't on the birth cert.
