I have read about a certain clause adopted at the time of President Bush...that as if protects the dependent children who would have been otherwise subject to the aging out clause.

My daughter is 18 at the moment, in September she will be 19.

We do not yet have our K3 (for me) and K4 (for her)...therefore we do not know for sure how much time we will have for Adjustment of Status...for her. (As I have read that it may take over a year).

Would she also be protected against aging out by that above mentioned clause?

I read about K3 and K4 from here....the words....Although the K3/K4 visa may allow the spouse and children into the US faster, they may now undergo the Adjustment process in the US, rather than entering the US with Permanent Resident status. This means filing for Adjustment of Status and work authorization, and paying the fees associated with these applications. It may mean problems with non-resident tuition fees at colleges, and other minor and major headaches experienced by current fiance(e) visa holders, including the sometimes nerve-racking experience of getting an older child adjusted to Permanent Resident status before turning 21.

Is that still then valid? Does she need to be adjusted to PR status BEFORE she will be 21? Or otherwise she will have to leave the country?

Thanks for anyone who has any experience or knowledge about this issue and who would be willing to help with a bit of information regarding this adjustment of status issue.

hi honey....we are in the same situation as you....except we came ove on k1 and k2.....my son is 20..and will be 21 in april.....we filed everything on jan 10th.....im not sure about anything at this point....soo many different stories....all we can do at this point is keep fingers crossed....so good luck, and all the best to you and your family.
