Hi everyone,

I recently married a Brazilian who was here on a j-1 visa last year, but now resides in Brazil. She is finishing up her schooling, and we are trying to determine what is the best path forward for us to 1) be together, and 2) maintain flexibility to have the option for both of us to live and work either in Brazil or the US in the future. One option we've looked at would be for me to live in Brazil for the coming year while she finishes up her commitments related to the j-1, and then come back to the US. I thought doing a DCF would be the best option while we are both down there, but it looks like the Brazilian consulate no longer offers this as an option: http://brazil.usembassy.gov/reconsiderations.html. Does anyone know if this is true? Is the USCIS Chicago Lockbox option faster than filing for an IR-1 or K-3 visa?

Hi,

Yes, Brazil doesn't do DCF anymore. http://www.uscis.gov/about-us/find-uscis-office/international-immigration-offices

Are you in the United States right now? And you wife is in Brazil?

If you recently got married it would be CR-1 visa. IR-1 visa is if you were married for 2 years.

K-3 is pretty much doesn't exist anymore.

Best option is a CR-1 visa.
