Hi. My husband is a UKC and I am a USC. We are trying to navigate the process of obtaining a visa for him. I have read tons but am not sure if I file the I130 and want to do DCF, where am I supposed to send the forms to? I embassy in London? I read that I should call the embassy to get a list of documents that I would need. I tried to call the number listed on the website today for visas and it is no longer in service. Any advice? Thank you.

If you have legal residence in the UK, then you can file the petition with the USCIS office in London, instead of the Chicago Lockbox. The USCIS in London isn't "the embassy" which is part of the Department of State...different government agencies that have office space at the same location. You would get petition approval from USCIS, then get the visa from the Dept of State via the "embassy" or consulate. They are like neighbors who don't talk to each other or know each other's business. You deal with each separately in turn.

Follow the advice Nich-Nick gives, as she is full of wisdom :). I would personally file DCF, IF you have the option to. As Nich-Nick says, you have to be a resident of the UK for at least 6 months to be eligible for DCF.

Looks like USCIS is going at a 5+ month rate, plus NVC is even taking longer now. Through DCF you are able to skip the delays and the backlog as it will go through the Immigrant Visa processing at London instead.

05th Sep 2014- APPROVED! Visa Status Issued same day!

10th Sep 2014- Visa in hand

Thank you both so much for your help. We've been married for over two years and have lived in England since we got married, so we've got the 6th months.

Are you legally in the UK. Do you have the right to remain? That is also important.
