Yes and that was clear before I even made my first post. My concern right now is of going there next month, proposing .. her accepting .. and then being denied entry. I'm currently in an online consultation with an immigration lawyer, gave him the story and just waiting for some info.

Got a reply back from the lawyer .. he basically said as long as she wasn't doing anything illegal and most importantly, we can show evidence of our relationship (skype screenshots/video, pics together, etc.) then it shouldn't be a problem. I'm still interesting in hearing from anyone else who may have had a similar experience though. Thanks.

Hi Animsoc, I have not been on this site for a while. I'm currently about to begin the process for my second k1 visa. (my screen name has changed I was "Louis and Yihan") . The situation for my first petition wasn't exactly like yours but to answer the question about work, my fiancée at the time hadn't worked in years over five(she was the baby of her family she was also 36 and I was 25). On the application I put that she had been unemployed for the years required. It was a thorn in our sides the whole process bcs history cannot be rewritten, but in the end they never asked why she was unemployed for that length of time. Only all of my docs were collected(I -134, as far as money-wise and employment )she was asked what my field of work was(I was at the embassy when she interviewed so she had myinterview to go through as well : ) ). Im not an expert but I believe they are pretty much only interested in your work and you meeting the requirements for the poverty guidelines, as you would be the one providing when she gets here. (My consulate was Guangzhou, China).

No worries on multi-posts. :)) Anything is helpful. I don't want to hide anything though .. like saying she was unemployed to cover WHAT she was doing. I mean .. that's how we met. If we cover the fact of her work by saying she was unemployed then we have to come up with a story as to how we met in the first place .. then have to cover things about that and .. it's not worth it. From what I've read, the big distinction between say, prostitution and "camming" is the actual contact and the fact that one pays for the contact in one instance while in the other, it's basically paying to watch someone else. As long as she hasn't broken the law (which she hasn't) and most importantly we can show evidence of our relationship, I'm told things should be okay. That again is the whole point of gathering info and insights ahead of time .. so that I don't ask her and THEN find out that coming here wouldn't happen.

Oh I agree with you, I just wanted to let you know about the working aspect and being unemployed as the beneficiary. Me personally (I am not qualified to quote or spew laws). But Camming is in no way shape or form prostitution, and like the lawyer said you MUST engage in sexual contact for money. I could be a naive 30 yr old but I would like to give an example: just bcs I drink alcohol , does that mean that I am an alcoholic or have alcoholism or will get a DUI? Now of course there is a significant contrast in situations but my opinion is she didn't do the crime so she doesn't do the "time" aka the consequences.

Yes .. true. Camming isn't illegal. Probably the reason it's an issue with a visitor visa is because the immigration people are actively looking for reasons why someone would be looking to get in and stay in illegally .. and that type of work raises red flags as to a person's possible moral values. But with a K-1, they know the person is intending to move here and even become a legal citizen so as long as what they are doing is not illegal .. should be okay. I'm still gona confer with some attorneys, probably go for a consultation soon with a firm in my area that specializes in immigration.
