My husband is very busy with work in the US, and I want to help him in any way I can in assembling AOS and IV while waiting for case number from NVC.

My husband has W-2 forms, and is qualified to use i-1864ez. The EZ instructions say that my husband doesnt need to include W-2s if he chooses to submit IRS transcripts. However, one of the criteria for i-864ez says this: "b. I am using only my own earned or retirement, which is documented using IRS Form W2"

I got few questions:

1. Is he supposed to include W-2s if he chooses to submit IRS tax transcripts?

2. Are IRS tax transcripts obtained online( http://www.irs.gov/Individuals/Get-Transcript ) accepted by the NVC?

3. Do they need the original paystubs or just photocopies?

4. Any other tips?

That is a statement to make certain the person using the 864EZA is not using self-employment or investment income to meet the poverty guidelines. Only income that is reported on a W-2 is being used. If you submit a tax return you must submit a COMPLETE tax return and all supporting documents--schedules, 1099s, W-2s, etc. To use the 864EZ the income must be from wages only--i.e. W-2. By submitting a tax TRANSCRIPT you are submitting what was actually filed and processed by the IRS and do not need to include any supporting documents like the W-2s. Using a transcript reduced the likelihood of receiving an RFE for an incomplete tax return.
