Hey guys I got a question regarding an error in my birth certificate. My father's name in my birth certificate is Arturo since that's what my father always thought as his name as he never tried to get his birth certificate in nso but when he tried getting a copy from nso it turned out as Arthur. Now I'm wondering if that will affect our paper not that we have already filed but is just preparing to file the papers this month. Anything I can do about it? Thanks in advance.

You could change all the paperwork to match his birth certificate listing his name as Arthur, doing AKA where ever asked on the forms for Arturo. His passport shows his name as Arturo, even though the BC shows Arthur.

Or look into changing the birth certificate:

You will need to change the birth certificate at NSO. If he has a passport, that will need to be changed, too - at DFA. Don't guess about this...it will hang up and delay your father getting a visa. Go to NSO and ask what is required to make the change. Of course, you will also have to note the AKA (also known as) on the petition and any other paperwork.

It will hang up your paperwork...sorry for the confusion. Re-read your question...ask someone at NSO if it will have an effect...you may be able to indicate AKA without further action. If it was your own name, there would be a problem.

I'm sorry about the confusion. It's spouse visa that I will apply for and that's the error that I saw on my birth certificate (my father's name). I am just wondering what can I do about it. And what do you mean by Aka?

OK, father is not getting a visa, you are. So it is your father's name on YOUR birth certificate that you noticed is different, not a major issue. Is your name and information correct? That is the vital info, that is what the embassy will be looking closely at. Your dad's name on the BC is the name he always uses correct? Then don't worry.

As for AKA, being this is your visa process and you are married, completing the IR/CR-1 you will want to get your NBI in your married name and an AKA with your maiden name.

Agreed with Hank. It won't matter now for your visa.

It will only be concern once you file a petition for your father (or parents), but it will be a long road until then. You and your parents will have enough time to correct your father's birth certificate.
