June retrogession affect on pending consular interview

We had priority date July 2013, submitted docs to NVC for interview in embassy, and we received notification that they are accepted on April 9th, 2014.

Now priority date is retrogessing in June while we have still no interview scheduled.

There is too much conflicting information on this, my lawyer says we are secured by paying and having NVC accepted our documents. Some people say that before you get the visa on your passport, you are affected so will need to wait again until its recent.

I am quite stressed, so would be really nice to see comments only from people who really knows about it, not comments or guesses. What is the exact point of process, where you have a valid visa allocation within the quotas?

I maybe quitting my job and deciding to go back to my country if my family will need to wait more.

I hate to be the bearer of bad news. Yes you will be affected by the retrogression. The embassy can only issue a visa when your priority date is current. Your lawyer is clueless.

Your lawyer is an idiot.

If your PD is no longer current, then a visa is not available to you.

Processing at the NVC does not mean you can ignore your PD.

The PD advances based on the number of potential beneficiaries. Sometimes more beneficiaries apply than there are available visas. So to reduce the number of qualified beneficiaries, the current PD is retrogressed so the number qualifying matches the number of available visas.

your PD is no longer current, therefore there is no visa available for you.

Before you make the decision to quit your job, maybe you can wait until October when the new fiscal year begins, and the new allocation of visas are made. when that happens, everyone is saying that the PD will move forward again to its pre-retrogression date, which would make you current once more.

I will bring then w their existing B1/B2 now, w no intent to stay. Hopefully they will be admitted to stay for a few months.
