Do not know if I am in the right forum, but hoping someone out there specifically Filippino, who has gone through the K-1 process and now has the two year greencard, or anyone with some knowledge of my question.

My wife and I (she is Filippino) and of course still a Philippine Citizen, she just got her 2 year conditional green card. Now of course the final step is the unconditional green card and then citizenship.

But, until she is able to receive the U.S. Passport once she becomes a U.S. citizen her passport from the Philippines will still have her last married name on it.

I have researched some, but , do not totally understand the requirements and the mumble , jumble terminology of the words. I think she can complete a ROM form and submit all the required documents, but I did read somewhere she can not get a name change on her passport because she is now a permanent resident here in the U.S.?? True??

All we are looking for is to change her name on her passport because now all her government issue ID is in my last name (her husband)

Again, bottom line is, I do not want to pay the required fees and fill out all the forums and submit originals/certified and many , many copies, just to be denied at the end of it all.

Again, I am american, she is Filippino, and is a Filippino Citizen, but now we are married here in the U.S. and she now has the 2 year conditional greencard. Can we still apply and will they allow her to change her name on her passport?? I realize once she becomes a U.S. citizen, this will no longer matter, because she will be able to get her U.S. Passport, but, for now, still would like to see if we can change her name on her current Filippino Passport.

Hoping for any knowledgeable suggestions or answers to this question

I am in the same boat as you, although a few steps back. My fiance just completed a successful interview at USEM and should be here in 2 to 3 weeks, so we will be doing the ROM thing too.

Although I have no specific knowledge that you seek, I will be watching this thread with interest.

Did you report your marriage to the Philippine Embassy?

Thank you, no, we have not reported our marriage to the Embassy. Did not know about this till I did some research. I had an immigration attorney for the Visa process and a person who does the forms and paperwork for our Green card process, and neither mentioned anything about reporting the marriage.

do you know if my filippino wife is suppose to report this or not?? Should not matter because in 3 years she will be applying for the U.S. citizenship

As far as the link you posted for me, thank you, but I did go to that site, and unfortunately, it is kind of confusing to me. There is a statement in this site that said something about can not change name if you are a foreign citizen, i.e., or permanent resident of another country, unless, I misunderstood the jargon on this.

The reporting of marriage is intended to satisfy the requirements of having your marriage recorded in Philippine database since it happened here in the US. At least, that is how I understood it to mean (We reported ours about a month after our marriage. No worries though because there is no time limit/deadline for such.)

If your wife will be getting a US passport anyway after becoming a US citizen, then you can just wait for that for her change of name to be documented. If she, however, will be a dual citizen, the Philippine passport will still come in handy.

Case in point: My mother who has lived here in the US for a long time became a US citizen but she still kept her Philippine identity/passport. Thus, she was still allowed to stay in the Philippines for a long time and not entirely bound by the laws governing American visitors staying in the Philippines. (She is still in the Philippines as of this writing, after more than a year of staying there already.)

You can probably call the Philippine embassy for clarification.

Interesting, I like your case in point.. So there may be some benefits to NOT completing the ROM...

There may be more hidden benefits also.. anyone know of any ? I think if you don't plan on ever living in the Philippines, buying property there, etc.. then not filing the ROM could actually be beneficial in certain cases / scenarios ...
