Hi All, I am a naturalized US citizen who’s looking to apply for adjust of stats (aos) for my wife, who’s here on B2 visit visa. Below is a little back groud on our situation....

On October 2011 I went on an international secondment for work to UAE for 2 years (with possible extension). Since my fiancé was already overseas so we decided to get married on November 2011 and she joined me in UAE few months after (we have been were together in UAE). Also, as part of my secondment I had annual visit to US so I decided to apply for my wife’s visit visa to accompany me and she was given 5 years multiple entry visa (we visited together during summer of 2013 for about 2 weeks). Due to work the reasons I decided not to extend my secondment and deiced to return back to US firm in January 2014 and my wife joined me few weeks after on the visit visa she had.

My question is that since she’s here and I’m not going back to UAE so I would like to apply for adjustment of status petition…Do I fit the criteria? Does anybody had a similar case or experience? Thanks in advance for your input.

She can apply for an AOS. But, you have to make sure that you did not lie on the B2 application about the relationship. A B2 visa is issued if you don't have an immigration intent. So, this issue might come up later. Make sure to read up on this before applying anything.

2nd Nov, 2014 POE Newark

6th Nov, 2014 - Married

7th Nov, 2014 - AOS, EAD, AP applications mailed to Chicago

10th Nov, 2014 - Applications delivered and Receipt Date

14th Nov, 2014 - NOA1 Date

20th Nov, 2014 - Received NOA1 hard copies

29th Nov, 2014 - Letter for Biometrics Appointment. Appt date - 12/10/2014

1st Dec, 2014 - Walkin biometrics done

13th Dec, 2014 - RFE email followed by Hard Copy on 12/19/2014 for Marriage Certificate

20th Dec, 2014 - Mailed RFE response with certified Marriage License and Certificate

21st Feb, 2015 - Received notice of potential interview waiver by mail

2nd Mar, 2014 - email received for EAD approved
