My husband just obtained his permanent residency from being a native american born in Canada and has recently sent in the I130 application. At first I had been seeing online that it has only taken people around a year from the time they sent off the I130 to the time they get a visa in hand but after looking further I think that only applies to US citizen petitioners? Because my husband is just a permanent resident and not an actual US citizen does this mean I may have to wait several years? Is there anybody out there that has obtained their permanent residency, or waiting for a visa with a similar situation?

As an LPR, he can file for you.

However, visas are limited to the spouses of LPRs. The wait is 2-3 years.

As an LPR, your husband will need to maintain a domicile (US legal resident) to keep his LPR status.

Any spouse being petitioned by an LPR is in the same position as you.

So he can't remain a permanent resident without living there? Right now were both currently living in canada and he just recieved his temporary permanent residency from the border
