can i reapply for VWP while going through i130?

hey all

ok so new to forum, i am currently going through visa process form i130 and got second notice of approval 2 weeks ago woo anyways i know i still have a long way to go most likely and would like to go visit my husband on visa waiver.....i have had the esta before and used up my time but can i reapply and visit now im going through this?....last time i visited was before i was married and i was pulled through immigration customs or whatever it is and they almost made me leave however i managed to convince them not to and told them the situation blah blah and got married on tht trip an they let me through with a nice big stamp saying ADVISED for 20th feb 2013 to leave then as i then had used up all my days for esta and couldnt return until i could obtain another visa ....i left on the 19th (my esta expired in january 2014) i know its probably a big No but do u think i could go bk i left when they told me to before probably not enough to prove i will return though...help

i havent seen my husband in 1 year 2 months ..and thats how long ago we filed the i130

You can reapply for ESTA, but your past experiences at POE won't be erased. Even an ESTA approval could mean a denial of entry. Had you been visiting a lot? Good luck.
