Hey Everyone!

I am new here, I just wanted to ask a few questions and just get your advice on general stuff and reassurance.

I met my Fiance November of 2012, He lives in Texas and I live in the UK. We talked via facebook and skype.

I first came to Texas in May 18th for 3 weeks and went back to the UK. My second visit was on August 25th and I stayed for 1 Month and 3 weeks, And now

I am currently in Texas until April 12th, This time I have visited for 2 Months and 3 weeks. We sent out the I- 129F Last week and still waiting for the NOA1.

When I was in Texas we went on a cruise together, We went to Chicago and San Antonio, We did stuff basically as a couple.

In our form we said all this and we provided pictures and dated them ad sent everything that was needed. (We will be getting married in CA)

My questions are:

1- On the USCIS website for Dallas lock box it said the wait is 5 Months.. Is that accurate?

2- Has anyone ever gotten problems since it is a same sex marriage?

3 - Can they deny it since Texas doesn't recognize same sex marriage?

4 - Can anyone provide me steps on how it all works?

5 - Is there a benefit that I am from the UK and not from a "High risk" Country?

1. No one can tell you what the wait will be. 5 months is their goal, after which you can file a service request and basically complain. From the Dallas lockbox they forward it to either California Service Center or Texas Service Center. If you get CSC you'll *probably* be processed in under two months, if not faster. If you go to TSC, well... no one can tell you. I'd say the average for TSC is about 3-4 months, but it's a lottery and varies wildly.

2. Not that I'm aware of, and it's against their policy.

3. No, but people have gotten RFE's because they wanted them to specify which state they plan to get married in. Just include that in your letters of intent and you'll be fine. We're in Ohio and haven't had any problems, just waiting for the interview right now

4. Read the guides. If you can't see the link on top look at the site from a computer. http://www.visajourney.com/content/guides

5. They'll be less suspicious that you're just trying to get a green card at the interview stage.

Yes, it is very important in your letter of intent that you that you name the US State you will be married. If you don't, your petition will be returned as an RFE and delay your process significantly.

My husband and I got married a month ago on the K1 Visa. Being of the same-sex was never an issue for us! As long as the rest of your petition is done correctly

Oh wow! Congratulations! :) We followed the rules and doub checked everything before sending it.Now we are waiting for the NOA1 sometime this week or next week, Depending how fast they are. How long did it take you guys to get the visa? ^_^

Im crossing my fingers that it won't come back to us, But we did double check everything before sending it, So it should be fine :)
