Hi,


My wife is currently working on her I-864 form supporting my green card application. She can provide the past two federal tax returns for the records, but not the third year's since she was a dependent/qualifying child of her parents and didn't file a return herself. She formulated a written explanation for the reason of the exemption. We were planning on providing this information together with copies of the past two federal tax returns to state our case. Do we need further documentation such as an official statement from the IRS?

She should fill in the past two years of income information and then on the third year, she can just hand write, "Not required to file. Claimed as dependent by parents." somewhere in the available space. No need for further explanation or documentation.

Above answers are correct but the foreign beneficiary's birth certificate is not sent to USCIS, so never needs any translation unless it's not in the local language of the Embassy where the interview will take place. If the petitioner was born abroad and is now a US citizen, their birth certificate is never required at all for a spouse visa process. Petitioners use birth certificates as evidence of US Citizenship. If this petitioner was born abroad, they'll use other documentation, like a Naturalization Certificate or US passport as evidence of US Citizenship.
