Did you sell your house?

I've been working in the tax department lately. I'll ask - but I'm not sure why there would be a " you have to sell within x amount of time" clause.

(Note asking is dependent on how busy the lawyers are, if they're heads down on a project I leave them alone...so you may not get an answer today)

Nothing wrong with delaying your move (well other than being separated a little bit longer). My plot is to delay almost two months: just so I can recoup some expenses/pay down some bills just a wee bit more.

I moved to the US on an L1 Visa in March 2012.

I sold my house only in November 2012.

Payed the mortgage on it the whole time.

It was still sold as primary residence even had gains on it and did not have to pay anything to the IRS because the capital gains have to be more than 250k for taxing a primary residence, which it still was.

The tip here is rent in the US (considered 2nd residence) and DO NOT, i repeat DO NOT rent out your house in Canada until it sells.

I really suggest you hire a good accountant on both sides at least for the year you move.

The IRS is a group you do not want to mess with and your taxes are important for getting a green card.
