Hello,

Our son completed his interview today, and was asked after the interview to mail additional documents, and the details will be sent to him via email. I checked the status on the CEAC site and it appears to be under Administrative Processing. He was not issued a 221g form, however. What does this mean?

Thanks

It means they will email him the details so a 221g will not be given, make sure to check the email and spam filters just in case it get "grabbed"

Sure enough, they did email it:

We are unable to complete the processing of your immigrant visa application under Section 221(g) of the Immigration and Nationality Act (INA), as amended, until you present the following documents or complete required action from your end:
From Petitioner *
- US Federal Income Tax Return(s) for year(s) for 2012
- W-2 Form(s) for year(s) for 2012 OR,
- Signed letter of explanation and legal basis for not filing Income Tax Returns
From a Qualified Joint Sponsor *
- W-2 Form(s) for year(s) for
They didn't specify what year was required for the joint sponsor, so we're sending in this years'. We already sent in a letter explaining why I wasn't able to file tax returns last year (was looking for work), so what else could they be requesting??
Thanks!

To cover "legal basis" you could complete the IRS 915 to show your income (or lack of it) doesn't require a tax return.

http://www.irs.gov/pub/irs-pdf/p915.pdf

the W-2 that matches the year of the ITR of the co-sponsor (but may not hurt to include a copy of the current W-2 also, co-sponsors are so difficult with USEM )

Also, I'm assuming a copy of the W-2 would suffice?

Did you provide a copy of the ITR (but not a copy the W-2) for the co-sponsor already? Then yes the W-2 is all that is asked for.

Appreciate the expert advice. Will have them mail everything we have tomorrow then, hopefully this all will suffice.

I know AP is kind of a "black hole" as far as completion times are concerned, but is a week to two weeks before issuance a realistic timeline? We were all prepared to get his plane tickets yesterday too...
