does a denied entry on a esta affect a cr1?


i know that a denied k1 can be reapplied can a denied cr1 be reapplied?


I also wonder if any of you had problems visiting fiance / boyfriend before filling any applications, and what did u say to CBP ?

we have not yet decided which way to go, but we wanna see each other and im thinking of visiting but i am scared





and what made you choose the route you took cr1 or k1? sleepy.gif

A denied ESTA does not affect your K-1 or CR1 provided the reason for the denial was not criminal, in nature. In other words, if your ESTA was denied because of a previous simple garden-variety overstay it should not affect the K or CR process.

You can't choose one route or another in the sense that K visas are for those who are planning to marry in the US, whereas the CR visa is for those who are already married.

If you and your finace/e are planning to marry in the US then the K visa is for you, but if you are already married or planning to marry in Spain, for instance, then you need to go the CR route.

If you are considering whether to marry in the US, the K visa is faster than the CR visa, so you might consider going that route and getting married here in the US.

Why was your esta denied? I would think it would only make a difference if you wanted to visit during the filing process.

Oh well then! Don't worry about it right now. When you visit, make sure you note that you have a wedding date/etc in mind that does not coincide with your visit. Tell the truth, be polite and smile!

It is true that the CBP will give you a hard time if you are visiting your fiance but you can mitigate that with documentation showing your ties to your home country. The only reason they would subject you to further scrutiny is if they suspect you will not be pressed to leave. If that were the case, you can always tell them you know you would be committing immigration fraud were you planing to enter the country, knowingly, to marry and AOS. You may offer to sign an affidavit to that effect if the going gets rough.

In regards to work, with the K-1 you wold not be able to accept employment in the US until 3-4 months after you are married and file for AOS. With the CR visa you are allowed to work the moment you arrive in the US.

thanxs peopel have told me not to say im visiting my fiance but i dont know what else to say besides getting caught in a lie by CBP counts as misrepresentation right ?

When I went through cbp in England, they asked me what I was doing there. I said "I'm on holiday". They asked where I was staying, I said "with my fiances' family". They said "you know you cannot marry and adjust here blah blah blah" and I said "I have no intention to, as our wedding will be months from now in xyz". She told me to have a nice trip.

I love a guy who looks like he could be on Criminal Minds as either an agent or a killer.

Hi

I am a IR1 to a american citizen and filed for concular processing and still in processing and

been visiting my husband twice the past year and been asked each time whats my reason for the trip (pleasure or business) I have always said that I'm visiting family and friends and not been denied once!

I do not think you should worry at all, if you have a valid ESTA visa and passport and a return ticket then you should be fine!
