I recently mailed the complete package of the I-485 and I-130.

It's for my wife (the immigrant) and she recently got her fingerprints done.

I am a student, not able to support her, I did an I-864 for myself. I also did another I-864 for my sister (joint sponsor) and she doesn't live with me which is why I didn't do an I-864A. She makes enough to support up to 4 people on the poverty guide line. I attached her pay roll stubs worth of more than 6 months since she got a new job last year. I also attached her previous years tax and w-2's. I didn't do the portion about her bank accounts and stuff since her income is pretty high.

Then I got a letter from USCIS saying:

Based on the documents submitted with Form I-864, Affidavit of Support, for the joint sponsor, the income did not meet 125% of the federal poverty line for the joint sponsor's household size.

Submit evidence of assets that meet the standards listed below or obtain a different joint sponsor. Assets standards must equal the stated difference between the joint sponsor's household income and 125% of the federal poverty line.

Can anyone think of why I received this notice? I only need to follow the poverty guideline for 2 persons right? For her and my wife since she is single and doesn't support anyone besides herself? Any help would be appreciated. Thanks guys!

Did you submit documentation to prove that your sister (the joint sponsor) is a US citizen? Does your sister have dependents on her income tax or does she have other people in her household like children, a husband etc?. Sometimes the RFE messages are vague. So it will be best to submit everything required for an I-864 sponsorship such as -

Previous year's tax return AND employment letter showing her current individual annual income and how long she's been working with the company AND/OR pay stubs (which clearly show the YTD above the poverty line) AND her birth certificate/ naturalization papers/ passport.

These should be fine. Sometimes they lose documents too..so just resubmit and make sure you submit everything required.

And yes, it should be her, your wife AND any dependents on her income tax and/or her household members

Okay, I left out the birth certificate part. Let me ask her to do her taxes asap so I can resubmit everything up to date. Thank you very much ManCharsey for the quick response! She only supports herself so on her tax, there are no dependents.
