Applying for K1 visa while living abroad

Hi All,

My fiancé and I both live in the UK currently. I am a US citizen and he is a UK citizen. We are both planning to move to the US and hence the reason I want to file for K1 visa. Questions:

1. My understanding is that I don't need to be living in the US to file the petition. Is this correct?

2. I can show evidence that I can support him. However, the income source at the moment is in the UK. I do file US taxes every year though. Is it ok to show on all the forms that I live and work in the UK?

1. Correct.

2. You'll need a US income for support, unless your UK income will be continuing once you've moved. If you don't have US income, you'll need a joint sponsor (anyone over 18, in the US and USC/LPR).

Since you both live in the UK you may wish to consider marrying and filing DCF for a CR-1 visa instead. It's faster and cheaper than the K1 path (see link in my signature).

2. that's shown on interview day, never prior. Still, must to show/prove up USA domicile, USA income for the I-134 by interview day. That's what, 182 days between now and then, to do all the research and plan formulation you need to do...
