We were already planning on filing his AOS on Tuesday. I am still planning on filing it then. Thank you guys that replied to try to help. We've had our hands very full the last month or so. I'm just trying to keep all our ducks in a row. :)

within 90 days of arrival - get married.

anytime after marriage, up to 2 years past the I-94 expiring, file for the AOS. After 2 years of the I-94 expiring, file all plus an I-130.

There's no regulation for when to file the AOS, as a K-1 visa holder.

Thanks for this information

I was a bit worried as my situation is quite similar. My fiance arrived in July of 2013 and we married September however we have yet to file the AOS due to the enormous fee. We are not ready but i wasnt sure if it would be denied and have to file additional forms which may equal additional fees. He is considered out of status but i dont think immigration will be knocking at my door within the next week.

Thanks!
