My hubby and i (well im doing the hardwork he's just making me snacks lmao :P) are preparing to file my AOS after christmas.. looking over what we need, it says about the tax returns... he only enlisted in the Military in April 2013 and never worked before that (he's only 20), so he hasn't filed any tax returns. From what I have read this is a big requirement for AOS, so I'm stuck on what to do. Do I send a separate note with the i-485 form explaining why he hasn't filed any tax returns and supply them with more financial support documents to prove he can still support me? Thankyou in advance and happy holidays from Alex & Dillon!

August 13th 2012: Met online on BF3 for PS3 wink.png
October 15th 2012: Connected via email, Facebook and were on Skype 24/7
November 14th 2012: Started our relationship
February 8th 2013: He traveled to the UK and we met for the first time ♥
February 14th: He proposed (eeeeeek)
April 19th 2013: Mailed our I-129F to VSC
April 30th 2013: He shipped off from the UK to U.S Army Boot Camp for 3 and a half months (waaaaa) sad.png
July 9th 2013: Transferred to TSC
July 23rd 2013: Approved biggrin.png (No RFE's)
August 19th 2013: NVC received packet
August 20th 2013: Case number received
August 21st 2013: Case left NVC and sent to Embassy
August 27th 2013: Embassy received case
September 10th 2013: Packet 3 received
September 11th 2013: Packet 3 returned
October 8th 2013: Medical
October 11th 2013: Received appointment letter
October 29th 2013: Interview (Approved) :DD
November 6th 2013: Visa in hand :DD ♥
November 19th 2013: POE, Newark International Airport
November 22nd 2013: Driving from NY to GA
November 25th 2013: Wedding♥

What did you use for your visa affadavit of support?

If you have no tax returns then some sort of proof from the military he has a job and how long for, payslips, I imagine he could get supporting docs from the pay office in the military detailing his salary and so on.

For my K-1 Affidavit i used his military pay chart, 4 LES's and his enlistment of papers.

The affidavit of support is done by him ...well you can fill it out, but he signs like he did the form. "He" also must write and sign the formal statement to include behind it that explains why he has no tax return for 2010, 2011, and 2012. It is not a note from you. If you will read the instructions to the I-864, it tells you what to do if no tax return was filed. Then include proof of his military income as you did before. If you interview, you can take a copy of your joint 2013 tax return to show at the Interview. He will have 2013 taxes done by then. Since you married in 2013, you can file jointly with him if you have a SSN. You don't have to be a greencard holder to do so. That's a new topic for later.

I apologize for the confusion in my first post, I am aware the affidavit is done by him and the "note" needs to be a formal letter and signed and dated, I was in a rush while writing so my words weren't very clear. I'm sure we'll have nothing to worry about. Thanks.
