Hi, Im visiting my girlfriend over the christmas period and we are planning to go through the I-129F forms and make up the package as it makes sense that we can both sign the forms and thoroughly check over everything while being together. i have a thought that worries me about doing it this way.

Are we aloud to file for the I-129F while i am there as a visitor? i would most likely mail her all the legal documents needed from me beforehand so that everything is ready to be put together when i arrive, would this look fishy to the USCIS conisdering they would see that i sent all the documents to file for a visa before actually entering the country as a visitor, they would know that because how else would my girlfriend have my paperwork in the package without me either mailing it or bringing it over with me. so am i supposed to tell POE that i am filing for it during my stay? or am i just being overly paranoid?

i hope that question makes sense, its hard to explain quite what i mean but its late and there is a lot of information to take in when filing for this wacko.png

If you say you are filing for K1 at POE it's helpful if you have some documentation proving that's ok. My fiancé was hassled at the border because they didn't know you can be in the country during filing/waiting for approval but he did get let in. We filed halfway through his 6 month tourist visa stay and had no issues.

Hello!! There is no issue with the two of you sending an I-129f petition while you are in the states! That actually will add evidence of your bonafide relationship, which is always a good thing. If anything happens to be mentioned about the specifics of your visit to the US, it's okay to tell them that you are working on sending in a Fiancé visa petition to USCIS. Saying that allows them to know you're trying to do the process the legal way, and you don't intend to cut corners.

My partner and I also filed together back in Feb...it was all fine and went smoothly. No issues.

Regarding docs, we created a shared Google drive and essentially had copies of everything on there in order. He (USC) printed out everything that he needed from me in the States, this saved me the hassle of bringing it over to the States in person/saving on postage. Everything is in copies for the petition anyway, originals are needed at the interview stage.
