DS-230 Child - What doc's required

Timeline

My daughter DS-230 is coming down the pipeline and I am curious if anyone knows what documentation will be required to support that I have the right to take her with me.

I have a seperation agreement which states that I share joint custody, however, she resides with me except for twice a year. This document is notarized by my lawyer. I also have an amending document which outlines that I have the right to take my daughter to the US permanently. It however is only witnessed by his/my lawyer.

Is this sufficient or does the amended agreement require notorization?

Did your ex sign the amended agreement? And was it filed with the court? I would think (although I don't know) that you would need a certified copy that it has actually been filed with the court.

Yes he did sign the amended agreement. No it was not filed with the court. I had asked my lawyer if it should be notorized and he said no. It was a legal binding document.

I guess I'll phone the Visa Centre and ask them. Thanks for your response

I guess it's probably a jurisdictional thing, I just know they have to be filed with the court here :) Hopefully you can find someone who can give you a definite answer - maybe the consulate would be best? Good luck!
