Hello, everyone.

I was curious if the USCIS perform IRS records check for the beneficiary.

I will be applying for an immigrant visa through CR1 category. I have worked and stayed in the USA for three years. I was wondering if USCIS can directly access a this IRS records.

Any insights would be great!

Hmm. I assume this means you have an SSN. So, yeah. They can go and look, but don't know if they definitely do.

Are you worried about it?

* I-130/CR-1 visa by Direct Consular Filing in London
3rd May 2013 - Married in London

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)
7th August 2015 - Approved / GC production

27th August 2015 - 10 year green card arrived

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

26th August 2016 - NOA1
13th September 2016 - Biometrics

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)
7th June 2017 - Oath

Yes, I do have SSN.

Not worried. There are some missing pay-stubs from my previous employer which might raise a question if USCIS are going to look into my previous tax and IRS records.

your ssn was listed on the i-130 or g-325a? I'm a thinking it'll just be a regular check, to see if you owe any monies.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Thank you for your reply. We have not filed the I -130 yet. I hope the missing payments from my employer would not flare any other consequences.

that's on the employer, not you.

if you filed the returns and owed money, well it's time to get square with the IRS, anytime between now and interview day.

a pay stub is a pay stub - not understand what role it'd play here but

if the employer not issue 'the final' w-2 for that year, to you, and you not file for that year, then it may be some problem.

You could ask your uscitizen spouse to run a mock-up with a 1040 for that year and see if you might owe any monies, just to get some mind-relief.

Yes, the employer was a big fraud and a shady agency. Eventually, it was shut down by the DOL. Now, if I were not being paid and out of status while I was on H1B; would that be an issue? This track can be easily found with the IRS and my previous I-797s and change of status within the USA in 2009. That is why I asked the first question if US CIS can access every single information from the IRS or any other agencies.

I hope to have a peace of mind as I go ahead with the application.
