Hi all,

I know this topic has been touched on briefly on this message board, but I could really use a little bit more clarification.

My fiancé has been living in Italy for over 5 years, but he is an Albanian citizen.. (He moved to Italy when he was over 18 years of age.)

1. Since he currently resides in Italy for well over a year does he need the police certificates from Albania also?

2. If yes, can someone please breakdown a little bit better where he needs to go to obtain the 3 police documents that are requested from Albania. I have read what it says on the USCIS website, but I wouldn't know how to explain that to my fiancé of where exactly to go in Albania.

3. If my fiancé has a typed birth certificate does he still have to go get a newly issued birth certificate?

- It says this on the USCIS website,

"All civil documents presented in support of a visa application should be less than one year old at the time they are provided. Only machine-typed civil documents are acceptable; Albanian authorities are no longer authorized to issue hand-written civil documents. Albanian birth certificates should reflect the bearer's current marital status at the time of issuance, and are issued in the bearer's current name (i.e. in a woman's married name, not in her maiden name)."

It seems like the answer is yes, but I just want to make sure as I'm a little confused.

Hi

Yes he does need police cert from both country's because he was over the age if 16 when he moved to Italy. Yes he also need one from Albania. As for where to get it done i opulent tell you you may want to check the Albanian and Italian threads. The birth certificate is fine.

1/27/2014 arrived at PO Box Chicago lock box waiting to be picked up

1/27/2014 (day1)AOS received by USCIS according to USPS online mail tracker signed for by R MERCADO

2/2/2014. (day7) text message and email from USCIS for acceptance of all forms.

1/31/2014 I-485 accepted receipt number and hard copy has been sent. Processed at National Benefits Centre.

1/28/2014 I-131 application for travel documents in initial review receipt number given and hard copy has been sent

1/28/2014 I-765 application for employment authorization in initial review receipt number given and hard copy has been sent.

2/7/2014 (day11) noa1 hard copy arrived in the mail for I-485 I-131 I-765

2/14/2014 (day18) biometric appt letter arrived in the mail. Appt schedualled for 2/26/2014 11.00am.

2/18/2014 (day 22) biometrics successful walkin.

4/01/2014 faxed expedite supporting documents to number on letter sent to me. Waiting waiting waiting

4/03/2014 (68 days) EAD and AP approved text message sent status post decision. Hooray !!!

4/7/2014 (72 days ) status change to card in production for EAD.

4/10/2014 ( 75 days) status changed after calling uscis regarding urgency of EAD. Also usps tracking number at 20.580pm

Hi this is info from travel.state.gov

"A full Albanian police clearance consists of three separate documents: a document from the District Attorney's office concerning pending and final criminal and civil cases, a document from the District Court concerning any active cases, and a criminal court certificate from the Ministry of Justice concerning any prior convictions. The Ministry of Justice certificate alone is transmitted directly from the Albanian authorities to the U.S. Embassy Tirana; it may not be accepted directly from the applicant.

To obtain the document from the District Attorney's office concerning pending and final criminal and civil cases, the requestor needs to go to the District Attorney's office in the district of his or her residence, present an ID, and pay the necessary fee.

To obtain a document from the District Court concerning any active court cases, the requestor needs to go to the District Court office in his or her district of residence, present an ID, and pay the necessary fee.

To obtain a criminal court certificate from the Ministry of Justice (in Albanian - Deshmi Penaliteti or Vertetim i Gjendjes Gjyqesore, issued by Judicial Status Office, General Directorate of Prisons, Ministry of Justice), the requestor must submit a photocopy of his or her ID card or birth certificate through the Post Office, and must pay the necessary fee.

IMPORTANT: Applicants must clearly note on the court certificate application made at the post office that they are applying for a U.S. visa. By arrangement with the Albanian authorities, court certificates for applicants for U.S. visas are transferred directly to U.S. Embassy Tirana. Therefore the applicant will not receive an original copy of the criminal court certificate nor is it necessary for them to send the document to NVC. Only court certificates obtained directly through U.S. Embassy Tirana are acceptable; applicants may not present their own certificates.
