Hello All,

I am unclear on a few requirements for a Permanent Resident application...I am a natural born US Citizen

I do not meet the 125% 2013 Means Tested income requirement on paper to sponsor my spouse. I do read where the spousal income and assets may be used when filing the I-130. The US consulate in my jurisdiction (China) refuses to answer this question via email claiming it is a legal question and must be answered by an attorney. Can anyone shed light on this for me?

In filing the I-130 is it necessary to provide a certified BC along with a valid passport????

The instruction's are all numbered and not either/or. in this area--so I assume them mean both must be presented at the initial application point. Can someone clarify this for me also?

Timeline

If you are just started filing the I-130 you send in a copy of your BC your husband BC and copy of passport marriage certificate etc. You husband income cannot be used unless that income is going to continue when he gets to American and it has to be from the same source after he become LPR and he has to be currently living at your residence. Evidence must be provided to support both requirement
