Hello All. I hope this will not be a problem. My wife and step-son are listed on the lease as occupants. The lease is in my name.

Ask your landlord if your wife can be listed as a co-renter/leasee and the son as an occupant. Why not?

On the other hand, do not sweat it too much. A lease is a piece of evidence of a legitimate marriage relationship, it is not THE evidence, there is a lot of others.

More important would be things such as life insurance policies listing each other as beneficiaries, and with a child, anything listin you as an emergency contact. School and medical records particularly. I submitted copies of the emergency contact lists for our son's school and from his doctor showing me as "guardian" or "parent". I also made sure I signed ALL permission and release forms for school or medical functions. I made a copy of each one and submitted them with our RoC packet.

If you canno tadd her, then submit the lese to verify her address with other documents she attaches, such as a copy of her drivers license. It is not so important that she be obligated to the lease as it is to prove you have a marraige and live together. "John Doe has a lease for this property. Jane Doe is his wife. Jane Doe's drivers license says she lives at that address"

This is not a court of law, the standard is not "beyond reasonable doubt" it is simply to provide plausible evidence of a realtionship NOT based on immigration benefits.

Never too late for anything. You only need to send her petition to them before October 20. There is no need to send it 90 days before that date. Btter to get evidence and delay it a little.

DO NOT falsify anything or back date anything, just do it now and use the current date.

Alla and I have a joint checking account. She also has her own account. ALL her credit cards, her car and some of the utilities are in HER NAME only. Some of the utilities are in MY NAME only. Our mortgage is joint. We have joint car insurance, joint medical insurance, life insurance on each other (Yes you can get a policy for her now or not...I doubt it makes any difference) I am listed as parent/guardian on all the boys documents (Pasha was a minor at the time)

If her son is filing jointly with her, YES attach his legal records. Unless she was somehow involved it will not affect her privileges. It MAY affect his, depending on his offenses. What COULD happen with a joint petition is that it could be denied because of his offenses and then she would have to re-file without him. I doubt it. I am being devils advocate.

How old is he? When did he arrive? The same time she did?

On the house title is fine. More important than the loan actually. Car loan is fine. Yes, here is ny list from my cover letter, copied exactly...personal information redacted only

NOTE: There are NO photos, NO "affidavits" from friends, no cards and letters, NO utility bills at all, NO credit card statements at all (NONE of these were "joint"), NO joint car titles. I did attach the titles as each shows the same address. We were approved without interview.or RFE

"Partial copies" of the tax return means the cover page to show names and address and SSNs. It is not required to attach an entire tax return for the I-751 but they must show they have filed taxes. Pasha (Pavlo) was listed on our joint return those years. He did not file his own tax return until FY2010

Enclosed please find a JOINT I-751 petition for removal of conditions of permanent resident status regarding my wife, Alla E. and her son, Pavlo V. . Please also find a check for $xxx, the fee for this form, and biometrics fees for two beneficiaries. My wife entered the US on a K-1 visa with her son Pavlo V.. Another son of my wife, Sergii V. is listed on this petition but as he followed on a K-2 visa he is not yet eligible to lift conditions. We are all happily living together and request that this petition be accepted for removal of conditions on the residence of my wife, Alla and her son, Pavlo.

Enclosed also please find the following documents to verify the status of our marriage and ongoing relationship:

  • Copies of the passports and resident cards of Alla and Pavlo. Pavlo is included in Alla's passport as per Ukraine procedures for minor children

  • Copy of our bank statements showing our joint bank account

  • Copy of bank statement of joint account of Pavlo and Gary

  • Copy of bank letter for I-864 showing date of adding Alla to our joint account

  • Copy of change of address letter sent to our bank (statements show current address as changed)

  • A partial copy of our 2009 joint US tax return.

  • A partial copy of our 2008 joint US tax Return

  • Copy of mortgage for our home.

  • Verification from my employer that Alla is recorded as my spouse.

  • Copy of car insurance in both our names and current proof of insurance.

  • Copy of homeowners insurance in both our names

  • Copy of medical insurance cards

  • Copy of Life Insurance policies showing beneficiaries

  • Copy of the title and registration of our cars, showing addresses

  • Copy of our drivers licenses showing addresses

  • Copy of documentation and correspondence from Pasha's school recognizing both of us as parents.

  • Copy of AR-11 form sent to USCIS to register change of address for Alla and Pavlo

  • Copy of Alla's credit union membership showing Gary as beneficiary
