Anynone can help plzz

My wife is a us citizen , we are married 4 months ago

I want to get green card , so confused alot of questions

1) is it better to apply from cairo and send i 130 to chicago or to travel to usa by any type of visa and apply from usa ?

2) if i ll send the i 130 how to pay the fees from egypt, can i do check from any bank in cairo?

Need ur help plz

1) If you married 4 months ago to a US citizen and she lives in the States then your Wife is the only one that would be filing the CR-1 petition on your behalf. There are step by step instructions in the Guides on here for the paperwork and fees that will need to be completed. Please see LINK and also forward it to your wife to read through it as ultimately it will be up to her to fill it out and complete it.

As for your statement of applying for any visa in order to get to the States and apply for marriage based immigration - I'll tell you right now that is seen as intent to immigrate and whatever other visa you apply for other than the marriage based one will be denied. There are no short cuts.

If your wife is with you in Cairo then you would mail the package to the States from Egypt as they've done away with most Direct Consular Filing (DCF) processes in 2011.

2) To pay the $420 filing fee for the I-130 there are a few ways. If your wife is in the States you may send her the money through a wire transfer either through your bank directly to hers or more commonly through Western Union. Both will require a fee for international money transfers. The second way is if your Wife is in the States she may wish to use the money she has to send the filing fee either through personal check, money order, or cashiers check. The third way is if your Wife is with you in Cairo and you guys have a bank account you may go speak with a banker to make a money order or cashier's check on your behalf to mail in with your I-130 to the States. They will do the exchange rate and conversion of Egyptian pounds to US Dollars and are familiar with the process for what is needed in regards to the fee for the immigration application. My husband didn't have any problem in the HSBC bank in Egypt.

As me and my wife we both live in cairo i ll send the i 130 from egypt and also do the check from a bank in cairo HSBC or CIB

How long does all the process takes ?

It depends on your case and other several variables from one year to few years I filed on December, 2011 and yet did not recieve any visa; still on administrative processing.......

Wow i didnt think that it ll take that much comparing to my friend he was also married in cairo to his usncitizen wife and then they travelled to usa and didi the papers from there it took 3 months and he got the social security no and green card is on the way ! That because he had already a tourist visa before marriage so he was able to travel after getting married , i thought i can do that too but a friend told me no shortcuts u have to go for cr1 ,

Make sure when you send the I 130 package that you flag it that you both live in Cairo together. Sometimes that makes them approve the petition quicker

The money has to be from a US bank

Easier if your wife sends from her american checking account or family in USA send it to you

Someone plz confirm the i 130 payment should be from a US bank or can it be done from bank in cairo ?

and if it should be from US bank my wife dont have can my relative do the check for me ?or what to do

It can be done from an international bank in Egypt and mailed with the packet. That's fine and there should be no problems. The bank knows what to do. We did that for immigration purposes at one point in our process.

Since your wife resides with you in Egypt you'd fall under what used to be called Direct Consular Filing you should look into that as well. I don't want to confuse you because part of the major processes of DCF have been done away with but not the idea in general. Some parts of the world do in fact still do DCF at the Embassy but it's not at the Egypt Embassy anymore since 2011 as it's now processed in the States. You'll file an I-130 like most everyone else however since you're applying from abroad they will treat the case like a former DCF application. It has been known to speed up the process as compared to those filing in the States.

DCF when it was still available at the US Embassy in Cairo used to take an astonishing 30 days turn around or less. The requirement to apply for DCF was that the US Citizen Spouse had to be residing in the country for a period of six months. You said you guys were married for four months, but perhaps she's resided in Egypt longer? They can verify the dates so be honest about it in your application cover letter. You'll want to use your foreign address to apply for the I-130 and indicate in a cover letter that your spouse resides with you in Egypt and the length of her residency thus far.

I did a brief search on DCF in Egypt and the last case that came up was processed in a period of 5 months. So it still seems relatively quick as compared to those applying from the States. Though with the continued unrest in Egypt everyone's petition has been delayed to some degree.

You may wish to contact that member and discuss with them how to go about applying from Egypt for verification purposes. Also there is a DCF forum on here you can browse through it though it's relatively inactive for the most part.

My wife last visit to usa she was back in early march so its 5 months now , but she always stayed in egypt for school and uni , but i can wait one month more if this is a strict rule although i didnt see it myself but i trust ur experience :) .

Other than that i think i now have the proper info to start for the i 130 and will do the payment from CIB bank

If your wife is residing in Egypt for school and University go ahead and start the application process. Let them know how long she's expected to stay for this and your intention of her residing there with you if the process takes longer than she's expected to be there.

With the cancellation of DCF at the Embassy in Cairo there doesn't appear to be the strict rule of residing in the country for the six month period. I think it would help the case process in the States as DCF if the prior six months rule was met, but I haven't seen the rule applied since DCF technically went away.

Again I strongly suggest contacting the other member I linked too in a prior post that recently did what you're doing. So you may have consensus on the matter other than just going off of what I'm providing. They've actually been through the process you're about to go through and may provide more insight.
