Timeline

Hello Friends:

Yesteday my wife (from Canada) received her choice of agent form from the Visa Center.

Questions:

Which is more advisable at this point; continue with immigrant Visa or wait for the K-3 approval from our application that was forwarded from Chicago to California?

Is there a difference in fees depending which route we take?

Can the medical be completed ahead of receiving a packet from State Visa Center or Montreal Consulate?

Can the medical be completed in the U.S. if she is visiting me there?

What is an AOS?

Many people in this situation continue to pursue both the K3 and the IR/CR1. The IR/CR1 is a superior visa, and your wife will be a Permanent Resident upon entering the U.S. If the IR/CR1 arrives at the embassy first, the embassy will ignore the K3 if it arrives later. In addition, if the K3 arrives first, and the I130 afterward, the I130 usually will also override it.

I'm not sure about the fee difference, but you would have to pay basically the same fees for AOS as the I130, and the I130 is already approved, so it might make sense for you to puruse that. Many Canadians come down on a K3 and then go back to Canada for the IR/CR1 interview rather than filing AOS.

When the medical can be done depends on the phsyician, some require a letter showing the need for the physical. I'm not 100% sure if the physical can be done in the U.S., don't see why not though.

AOS is Adjustment of Status when a person is in the U.S. and files to adjust status to become a permanent resident. Some people also talk about AoS which is the Affidavit of Support.

01/01/07 - NVC generated IV Fee Bill (postmarked 1/17 though!)

01/03/07 - returned AoS Fee Bill via Priority Mail (James' shortcut)

01/15/07 - NVC generated AOS package

01/22/07 - received IV Fee Bill - overnighted back to NVC same day

01/27/07 - recieved I864 package; 01/29/07 - overnighted I864 to NVC

01/29/07 - DS230 generated (phone system not updated, email response 2/5/07)

02/05/07 - mailed DS-230 to NVC via express mail

02/20/07 - CASE COMPLETE!!

04/18/07 - INTERVIEW!!!! - APPROVED!!!!

Michael's K-3:

09/28/06 - NOA1

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal
