Hi,

My sister in law and his family (husband and son) will be entering US based on K3 visa. My sister in law's parents filed for family based K3 visa, so she is a primary immigrant. Do all of them need to enter in US together? Can her husband come alone later?

Thanks,

Samir

A K-3 visa is for a US citizen to petition a spouse.

Perhaphs, you are confused with the F3 family preference category?

In the case of an F3 family preference category, the primary beneficiary must enter the US before or at the same time as the derivative beneficiaries. Derivative beneficiaries can enter with or after the primary beneficiary. Derivative beneficiaries cannot enter before the primary beneficiary.

Your sister-in-law's family does not have to enter at the same time. Her husband can enter at a later date.
