Hi,
I am an Irish citizen. I am coming over to the US in July for a month to my fiance. We plan to marry while I am there.
Then start working on my visa.
I leave in August,
But hope to come back in October.
If i bring all of the relative documents from Ireland...medical, criminal cert, etc..
is it possible for me be in the States with my husband, while we are working on my Visa...while it's processing?

No. You will be travelling on the visa waiver program, which only allows 90 days at a time, and, in general, no more than 180 days in a rolling year- you can visit during procesing, but not stay.

I would strongly recommend not bringing the police cert etc with you, because if your lugage gets searched, they may see this as you wanting to illegally use the VWP to come and stay with your hsuband, which would be visa fraud.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

so once I leave in August, and we have filed the relevant forms, i can do nothing but wait to be called for the interview...and soon after will be told if i have been granted the visa?

It's a longer process than that. Have you read this guide? http://www.visajourney.com/content/i130guide1

There are many stages, but two significant main ones:

1. Your husband files a petition for you - the I130. This is asking the USCIS to allow you the opportunity to get a visa, with him as a sponsor of you.

2. Upon approval of the I130, papers will be sent to your local consulate, inviting you to apply for the visa proper (CR-1 visa).

The first stage takes 5 - 8 months, the second 2 - 5.

4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)

1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)
7th June 2017 - Oath

You can come back in October to visit him, and for Christmas or whatever- you just cannot stay with him all the way to interview, because the whole proces will take most of a year. You also won;t have the medical or need the police cert till towards the end of the process.
