Hello,

Hope someone here can help me.

I was granted a K3 this year but I haven't entered the US as yet largely due to personal circumstances. I'm not in any great rush because I'm in the UK with my wife.

This K3 expires in a few weeks and I was wondering what happens if I do not enter within that time.

As I understand I should have another interview pending......... for IR-1 or something.... We've been married nearly 2 years now.

Or does the whole process start again?

If you do not use the K3 before it expires, then you'll have to start all over again for a new visa.

Have you received anything regarding the I-130 petition and the CR1 process?

According to the Visa Reciprocity table a K-3 visa is valid for 24 months, and is multi-entry.

Look at your visa and check it's expiration date again, also it can extend beyond the expiration of your passport.

K-1----NONE----ONE----------6 MONTHS

K-2----NONE----ONE----------6 MONTHS

K-3----NONE----MULTIPLE----24 MONTHS

K-4----NONE----MULTIPLE----24 MONTHS

It's now about 5 1/2 months since it was issued.

Timeline.

Married in UK 31st Dec 2004.

Settled in UK short-term because immigration to UK is a normal, sensible, straightforward and understandable procedure. It follows a process of commonsense and logical thinking. The paperwork is processed in a timescale you would expect from normal human beings. We can also enjoy the comedy of being subjected to US immigration protocol without the frustration of being apart. It's very amusing from this vantage point.

I understand the visa is valid for 24 months but I believe I must enter the US within 6 months of issuance.

Contact the Embassy and ask about extending validity, I know that they can do it for other types.
