Dear All,

Below is the list of documents i am planning to send out to USCIS to petition my removal of conditions from my conditional GC:

Please review

The only question/issue i have is, i am living with my In laws therefore i have no mortgage/rental agreements to show.

Did any one write a letter explaining why they don't have mortgage or rental agreements.

OR can anyone be kind to provide this type of letter if they have drafted for this purpose?

I am planning to have this letter signed/notarized by my father/mother in law..

Please advise.

Enclosed please find a JOINT I-751 petition for removal of conditions of permanent resident status for my husband, (Beneficiary). My husband was awarded Adjustment of Status to Conditional Permanent Residence on MMM, DD, YYYY. My husband entered the US on Student F-1 visa MMM, DD, YYYY.

We are happily living together and jointly request that this petition be accepted for removal of conditions on the residence of Beneficiary.

I am enclosing the following:

• Check of $590.00 for form I-751 ($505.00) and biometrics (85.00), payable to U.S Department of Homeland Security.

• Completed form I-751, signed by both [beneficiary] and [uSC Spouse]. We are filing this petition together.

• Copy of Beneficiary’s Permanent Resident Card (I-551). Front and Back.

Enclosed also please find the following documents to verify the status of our marriage and ongoing relationship:

• A copy of the approval letter of [beneficiary] permanent resident card

• Copy of the joint tax return for tax year 2011

• A partial copy of joint tax return for tax year 2012

• Original affidavits sworn by friends that knows us quite well. (Note: We have attached 2 letters and they are notarized)

• Copy of our Marriage Certificate

• Copy of our birth certificates

• Copy of our driver's licenses showing same home address

• Copies of our wage/income statement forms issued by our respective employers showing same address of residence:

- USC Spouse’s Form W-2 for the tax year 2011 & 2012

- Beneficiary’s form W2 & 1099 for tax year 2011 and form 1099 for tax year 2012

• Copy of our passports including the page of the entry/exit stamps from our India trip in December 2012.

• Copy of Empire Blue Cross & Blue Shield health Insurance policy showing the spouse

(Beneficiary) as beneficiary.

• A letter from Bank of America and American Express Costco Club verifying the joint accounts under both of our names and joint account monthly statements.

• Copy of joint credit cards from Bank of America and American Express Costco Club with all the numbers blacked out except for the last four

• Letter from Geico auto insurance company verifying joint auto liability coverage under both of our names

• A copy of our home phone bills for various months.

• A copy of our travel ticket to Boston vacation in April 2011

• A copy of our cruise ship tickets to Bahamas in November 2011

• A copy of our travel tickets to India vacation in December of 2012.

• Some copies of the pictures we took together and some with families over the past few years

You may feel free to inquire at any of the sources of enclosed documentation for validity of their statements, and you are always welcome to visit our home should you ever desire to do so. Please advise me if you have any further questions or problems related to this petition.

your list of proofs looks great. As for the rental agreement, you can have your in-laws write a simple letter explaining that you are living with them. Make sure to include the date you moved in and why are you living with them. I don't think it needs to be anything fancy. I have seen some plp download a sample lease from google and then just change the names and have both u guys and ur in-laws sign it.

Helo,

I am sending my I-751 package tomorrow, do I need to put copies after our birth certificates (my husbands and mine) and marriage certificate?

I just read this post and now I don't know if I should include those copies or not.

I mean, we already included those copies in our I-130 package and I really don't want to send more pages than we have too...we already have lots of pages :(

I understand that USCIS should already have your birth & marriage certificates.

I sent them to be on the safe side since it wont hurt to send extra piece of documentation.

Therefore you dont have to stress on these certificates.

Though, other documents are critical as mentioned in my cover letter items.

Take your time to examine you evidences completely along with your I-751 petition before sending it out. I think some of your evidences are irrelevant to the bonafide of your relationship so therefore they are not necessary to include along with your I-751 petition. Some of the irrelevant evidences are - Copy of your Marriage Certificate
• Copy of your birth certificates.

Other evidences are good. But I would recommend that you submit joint copies of your entire tax return of each year than a partial tax return. A copy as you stated will not be a good idea. Most of your evidences show that you only have copy of evidence instead of copies of all the entire evidences showing the entire 2 years you have been living with your spouse. Also Affidavit from your friends is good but I will recommend that you support it with other evidences if they attended your wedding or your sign marriage certificate or any other related evidences. Your health insurance is good as you added your spouse as the beneficiary, the officer would like to see that it has been used or activities of the Health insurance, even if it has not been used submit evidences of your paystubs showing that such money was taken from your paystubs by the Insurance for every pay day although it has not been used. If you and your spouse have been using it, submit evidences to show that it has been used. Your joint Bank statement is great and it is a wonderful evidences. Please make sure that you submit the entire statements of each months showing the activities till date. I. The officer would like to see that both of you are helping each other. If other thing needs explanation, give them a clear explanation in a separate sheet. If you don't have lease or mortgage, explain the reason for such.

Most importantly review the petition to know if you have submitted enough evidences showing the entire 2 years. Submit as much evidence as you can that you have together with your spouse. Do not underrate any pieces of joint evidences you may have together . Date every of your joint photos taken with family and explain the events on the photos for good measures in a separate sheets if possible.

I think I have all the "critical" evidence. Can anyone advise if I should include something else than this:

Couple of items which i sent:

  • I had sent my full detailed month by month credit card statements (Costco, Bofa etc) so the officer can view the activities on the account to ensure it was used.
  • Copy of your passports including the page of the entry/exit stamps from your vacation trip

Your list looks great.

Couple of items which i sent:

  • Copy of the approval letter of [your] permanent resident card (letter you received with your conditional GC, it has your application number barcodes so makes it easier for the officer to scan)
  • I had sent my full detailed month by month credit card statements (Costco, Bofa etc) so the officer can view the activities on the account to ensure it was used.
  • Copy of your passports including the page of the entry/exit stamps from your vacation trip

Oh, thank you, you are right about the letter that arrived with the GC, it has that barcode, but so does the GC, they just scan the GC when you travel.Maybe I'll include that letter.

-I've included in my package statements for Bank of America debit card+checking account and Bank of America travel rewards credit card, we don't use any store credit cards, like Costco or BJ's because we don't need to buy lots of stuff, it's only the 2 of us and my husband preffers to just pay instead of using 10 credit cards. So we don't have any of that.

I have cards from Petsmart, CVS, Rite Aid and other stores but they're not credit cards, they just offer you lower prices or discounts. So.. no good.

The statements for the debit+credit cards we're using show all the grocery shopping&stuff we need to buy..

-I didn't put any passport copies because we went in California for vacation, once in LA, once in San Diego. :(

as far as you have joint spending activity such as grocery, eating out or entertainment etc. on one card or many which you can show, you are in good shape.

USCIS officer's focus will be on the usuage of the joint accounts since lot of folks just open the joint account and dont use them..

copy of the passport is not mandatory, i added them as additional addendum, you already included your travel tickets so you are good.
