Hello everyone,

Hope you can help me!

While visiting the US on my B1/B2 visa, I got married to a US, on the spur of the moment. Now I am putting together a packet containing the G-325A and have a bit of confusion with the residence definition for the applicant's residence last five years question. I came on a long vacation for 4 months and 2 weeks back in 09-2011, should I list this period and address as one of my residences within the 5 yr period. I have read different opinions such as: applicant should include trips/visits to the US during that time frame; extended vacation is not considered residence; if a person doesn't request a change of address during that time it is not considered place of residence; living for a few months under a visitors visa doesn't make it residence; if a person lived for a few months in a place that's is considered residence.......What is the true answer to this residence question?

Hello everyone,

Residence is where you expect to live and have your primary domicile. For example: a college student is a resident where his/her parents live even though he/she is living for a long period of time at the city where the University is. If this was a trip and you were living at a temporary location, but consider another place as your domicile then the vacation location is not your residence. I define residence as the place where you expect your shoes to be each night and the bed you wish you were sleeping in  .

I would not list it as you say yourself it was a long vacation and not a change in residence.

Good luck,

Dave
