Hi all,

- I'm a student (F1) marrying a USC, applying for AOS right after.

- My wife's income is not enough to fulfill the requirement.

- Mine is, but I've read mine could and will be considered "not continuing from the same source", since I'm graduating in 1 or 2 years.

- We have a joint sponsor that fulfills the income requirement by himself, no problem with that.

- We will have a joint account (she added to my account) right after the wedding, with funds above 3x125% poverty line.

The two questions:

1) Should my future wife (the sponsor) include my income in 24b anyway? I ask this because I see two types of problems

a) She includes it, they say "this will not continue from the same source and you were trying to use it as such", this creates a problem

b) She does not include it, that is not a correct assesment of the total household income, this creates a problem

2) Should my future wife (the sponsor) fill out the assets portion anyway? Here, again, I'm not sure between:

a) She fills it, they don't like that the she was recently added to the account, or that the funds are not so much larger thatn 3*125%PL, that creates a problem

b) She does not fill it, but assets do exist, and her income is lower than the requirement, so she should have filled it.

Your income must continue from the same source and you must provide proof that it will in order to include it. Your wife can list your assets on her I-864 and provide documentation of them. You are using a joint sponsor, so I do not think it matters all that much if she lists them or not.
